Netflix had a documentary Called Divorce Corp. it may still be on.

It showed how common it is for Women to make these false accusations.

I believe some attorneys encourage the practice.

What kind of jail time could someone get who accuses their spouse of child molestation or rape and perjures themselves? Would it be months, years or double digit years?

I know it depends on the seriousness but to me, theses are pretty serious. Ruining lives and whatnot.

I hate to assume, but I should have gone with my gut in this case.

Should face the exact sentence the man would have faced for the crime he was falsely accused of committing.

Well sure, as long as you make the threshold for a conviction "beyond a reasonable doubt" I can live with that.

However, many people need to understand that a not guilty verdict =/= a false accusation.

Depends. In Louisiana, La. R.S. 14:123 has your answer sort of. Again, this is in the context of perjury, which is a false statement under oath:

quote:

(1) When committed on a trial in which a sentence of death or life imprisonment may be imposed, the offender shall be fined not more than one hundred thousand dollars or imprisoned at hard labor for not less than five years, nor more than forty years, or both.

(2) When committed on a trial in which a sentence of imprisonment necessarily at hard labor for any period less than a life sentence may be imposed, the offender shall be fined not more than fifty thousand dollars or imprisoned at hard labor for not less than one year, nor more than twenty years, or both.

(3) When committed in all other cases in which any other sentence may be imposed, the offender shall be fined not more than ten thousand dollars or imprisoned at hard labor for not more than five years, or both.

She has implants if she would wear them but not all deaf women are bad mothers. They at least have the sense God gave a mule and know to look over occasionally.

This. Losing a rape case by not meeting the burden of proof or some type of error on part of counsel and then being exposed to the same penalty as the accused would have been if convicted is a terrible idea.

I have little doubt there are people on this board who do not understand the subtleties.

If you believe false accusations are a problem, then I'm fine with any proposed fix that does NOT intimidate real victims from coming forward.

Unfortunately this one of those areas that you have error on the side of the victims. No system is perfect. Abuse is going to happen with the best of intentions. My concern is that the accused gets a fair hearing. Beyond a reasonable doubt is a very high threshold. It hopefully will keep my friend out of harms way.

Somehow rebeloke being around this kind of situation is not surprising.

I've been alive a long time and my peer circle hasn't ever included a deaf, cheating, pedophilic-accusing mother.

I gotta get out more.
