all cars should have dashcams.

They are too cheap not to have one. Since this car did not have one, they will likely never know who's hitch it was.

lady in VA killed yesterday at the beach. strong winds picked up a large beach umbrella which hit her in the chest and killed her

A friend had that happen in South America. Piece of metal came off a truck and broke his moms cheekbone. Doc said a little higher and she would have died.

Holding a 10 pound piece of iron in place with a hitch pin and one of these always makes me question the legitimacy.

If I lived in Lubbock and walked outside and realized my hitch was missing I think I'd shite myself.

Only problem is it may have fallen off earlier and was kicked up by another vehicle. Even with dash cam they may never find out.

I can't imagine losing someone that way. Having to sit in the seat next to her as she passes.

That pin is pretty heavy duty.

Either Way, i use a master lock pin to prevent theft.

Something like this almost happened to me. An 18 wheeler flung a large piece of sheet metal up off the road and the edge hit the frame of my truck right above the driver side window, leaving a huge gash in the metal. If that thing had hit 3 inches lower, it no doubt would have crashed through my window and done some serious damage to my head.

I've heard stories of lug nuts popping off of big rigs and hitting passing cars. They're like bullets and can rip through car windows and car doors. It's scary stuff.

It's curious that there is a sentiment that the driver of the car that lost the tow hitch should be held criminally liable - for what, specifically?

It raises some questions.

How do we know it wasn't some mechanical failure? Maybe the clip holding the pin broke and over time the pin worked it's way out.

I think we can all agree that it was accidental. The real question is, in this situation, what would be considered criminal negligence to the average person?

How is this terrible tragedy any different from other traffic fatalities caused by an accident involving another driver? What constitutes negligence in those cases?

Someone pulls out into cross traffic, and states, "I just didn't see the other car. I guess I should have been more careful." Is that person charged with a serious crime (more than just a traffic citation) like negligent homicide?

I don't have an answer, I am seriously curious about what others think.

Was driving on I-44 one evening and they were doing construction so the lane to the left of me was raised probably 10 feet higher than the lane I was in.

Couldn't see any of the traffic in the above lane.

A large chunk of tire probably 8"-12" by 6" comes flying over and hits directly in front of me on the driver side windshield. Scared me half to death as it seemed like time slowed down and I thought it was coming through the windshield. Luckily it didn't though, or that would have been a very bad day.

That doesn't really answer the question. Criminally liable or civllly liable? To what extent?
