If I'm not mistaken there is already an agreement that was reached between developed nations saying that no one could commercialize the moon or space - or something to that effect. I am just going off of memory here.

The US is a party to a few treaties that basically say you cannot own the moon, lay claim to the resources on the moon, or develop military complexes/weapons of mass destruction. Apparently commercial development is vague and there is nothing I can find that explicitly discusses it one way or another.

I read a scifi story along these lines many years ago. Someone used electromagnetic waves in the upper atmosphere to create an illusion that the stars had rearranged themselves to spell out a commercial message. It all failed when the perp failed to pay his electric bill.
