In Louisiana to successfully prosecute a Bad Check, you'll additionally need some more information to corroborate that it was the exact individual who actually wrote the bad check.

Normally, this is a Driver's License # and Date of Birth from that government-issued document. Some DA's will not prosecute Bad Checks without this information.

I would think their take is that merely a signature on a check (to them) does not constitute a strong enough legal case to proceed without the DL# & DOB information. A person could have stolen someone else's checks and forged the signature on it.

Send ten day demand letter and when no response bring it to the DA.

They will take care of it.

Old baw is ignoring your texts because he does not have the money. Show up at his house with a couple of cups of coffee and sit down with him and ask what the plan is.

Be polite until the agreed upon plan is violated.

And that's why you've been inside the EBRPP numerous times. However, I partially agree with you in regards to dealing with the legal system. The legal system in BR is a joke. I wouldn't put any faith in it, especially in a small claims court situation.

Also, immediately file a lien on the property. A materials and labor lien will protect you in the long run, but you MUST file it within the prescribed period of time. Many, many years ago I performed about $15,000 of work for a homeowner who was an attorney. I chased after a check. It never came. I filed a lien, but didn't realize I had waited until it was too late. Eventually, I determined that he did this to a bunch of contractors. We all waited too long because he kept promising he'd pay us. Eventually, I filed to enforce the lien, and he countered with a counter-suit, claiming it was a malicious suit and that my lien had no merit because it was filed too late. My attorney reviewed and said he was correct, but that although my claim was legit, he could afford to fight the claim and eat me up with attorney fees. The bastard was a crook to start with.

File your lien asap.

1. Get copies of the check from the bank.
2. Go to the police.
3. File a criminal complaint.
4. Let the *sshole avoid the police.
5. Put a lien on house.

He will never be able to sell the house or refinance it with a lien against it.

His credit will be crappy because of his legal troubles.

He will say he is unhappy with the work and refuses to pay for it. Hope you had a witness as to how happy he was.
