West Virginia became at least the fifth state to ban the direct-sales approach practiced by Tesla Motors following Friday's signature by Gov. Earl Ray Tomblin.

The bill was championed by West Virginia's Senate president, Bill Cole, who is an auto dealer in his home state and Kentucky.

Tesla denounced the legislation.

Texas, Arizona, Maryland and Michigan are the other four.

Isn't this a major conflict of interest for the senator that proposes the bill runs a business that will benefit from it?

I'm shocked, shocked that you would accuse an illustrious legislator of such a thing.

Sure, John Oliver recently did a piece on congressmen who owned pay-day loan chains being allowed to vote on laws that would have shut them down for predatory loan practices. This kind of thing seems to just happen as long as no one makes a big fuss.

Lol, that fricker should've recused himself from the process, not the other way around.

If this isn't blatant crony capitalism to you, I don't know what to tell you.

The biggest issue with the American political system isn't the politicians, it's the uninformed, apathetic electorate.

An apathetic voting population is what allows self-serving politicians to utilize power for their own interests. I would agree it is just as much on us as it is them.

I think it's a little more than that, big time politics is an arcane society that's pretty tough to break into, hard to change things if you can't get into the arena

Kind of like that Alabama state senator, also an OBGYN, who tried to repeal a law passed after a woman was released too soon from the hospital following childbirth and bled to death. Of course, she was one of the doctor-senator's own patients and he was the one who sent her home...

Same reason the funeral business screamed for legislation that everyone has to be embalmed before cremation. Making money trumps all! Pretty soon everything will be legislated.

Since when has any legislator not had some sort of interest in a bill he wants passed? Even in the ideal case he's doing it because his constituents want it to happen.

Case in point - Virginia a few years ago substantially raised the penalties for reckless driving (doing 81mph on an interstate in perfect weather will get you that charge by default). Voter backlash was such that the legislators realized their jobs were in jeopardy and so it was repealed the next year. That's self-interest working in the voters' favor.

That said, the original law was sponsored by a legislator whose day job as an attorney was ... to defend people charged with reckless driving.
