quote:

Race, as a matter of constitutional principle, cannot factor into the selection of jurors for criminal trials. But in the American justice system, anyone with a bit of common sense and a view from the back of the courtroom knows the colorblind ideal isn’t true in practice.

Racial bias largely seeps in through what’s called “peremptory” challenges: the ability of a prosecutor — and then a defense attorney — to block a certain number of potential jurors without needing to give the court any reason for the exclusion.

quote:

Folk wisdom, among those familiar with the song and dance, is that prosecutors use these challenges to remove nonwhite jurors, who are statistically more likely to acquit, while defense attorneys — who can step in only after the pool has been narrowed by prosecutors — typically counteract by removing more white jurors

quote:

When the dust settles at the close of jury selection, defense attorneys’ actions in the last leg of the process do not cancel out the combined skewed actions from prosecutors and judges. The consistent result is African-Americans occupying a much smaller percentage of seats in the jury box than they did in the original jury pool.

Jury selection is retarded in the first place.

Should be 12 random people and that's it.

Each side should get as many "for cause" challenges as is necessary to seat a jury and alternates. Peremptory challenges should be scrapped altogether.

I am not reading that, but is this person speaking as if he wants to be selected to jury duty?

I wouldn't say jury selection is racist, it all depends on the case and the attorneys as to why type of jury they are trying to put together.

Much the way AA's mostly (90%) vote one way politically, it is pretty certain that they vote one way in jury trials. Or at least more likely.

Whereas whites you get more of a mixed bag.
There is age "racism", too.
Just no one is going to complain about that.

If you are guilty why wouldn't you want cognitively deficient people listening to the evidence?

Is it racist when plaintiff attorneys strike white military members and cops?

Does he consider the affect of "smart whites" that go in, and instantly take themselves out of consideration so they can get back to work??

Juries should be made of professional jurors. People who know the law, do it for a living, etc. Jury of my peers, my arse.

If someone makes a Batson challenge (states that your peremptory challenges were not based on race), then you have to give the court a valid, non-racially based reason for your peremptory strike.

This. Most of my “peers” are complete idiots. I don’t want them if I’m innocent

You wouldn't say that if you've ever been involved in a trial. Do you even voir dire, bro?

A reversal of the jury's verdict isn't common, is it?
