1st and 2nd offense in CO is a misdemeanor and will cost you a minimum $10k for the first. If you're in an accident and someone is injured or property is damaged it's an automatic felony with likely jail time.
Also there's no limit on time between DUIs. You can have a 1st offense then a second 50 years later and the first one still counts.
CO is not a state you want to be drinking and driving in.

An uber driver checking his/her/their phone for the next fare is likely more dangerous on the road than someone between .05 and .08.

So given this, you don't think states have any sort of financial incentive to create as many "drunk" drivers on the road as they can?

I agree with your sentiment...but do you realize that .05 isn't even close to being impaired. 2 glasses of wine or 2 beers at dinner and you could end up blowing .05 on the way home. And if its a petite woman, 1 drink may even get her to .05 limit. Utah isn't doing this for public safety...its a money grab.

The drunks will still get behind the wheel until the penalty is stiffer.
Lowering the limit to .05 is just a loss for someone who enjoys going to a nice dinner and having a glass or 2 of wine since now they'd be at risk of being over the limit after such a small amount.
