Traffic Accident - Who's Fault?

Car A pulled in the parking spot. Car B pulled in the spot right after.

Car A swung their door open and damaged Car B as shown in the picture.

Car B thought they were fully pulled in and stopped. After comparing door position to the damage there seems to be a 5 to 6 inch difference. So Car B was in motion but practically all the way into the parking spot before struck by the door.

Who is at fault?

There is no fault determination in private property accidents. Hope you have full coverage.

Car B, failure to yield. Car A has become a pedestrian. IDK, but that would be my luck in said situation.

doesn't matter who's at fault..

it's a parking lot and you are on your own.

..it's one of the reasons why I don't like pulling into a spot next to a car that had parked ahead of me.

No fault in parking lots. Enjoy paying for your repairs caused by the stupidity of others or yourself

This is why there's no fault in parking lots, it's impossible to determine clear fault

To me car A is slightly more at fault than B but they both must be clutzy.

I'd say A. B had possession of his spot. A encroached.

Even though there's technically no one at fault (as others have mentioned), it's definitely Car A's "fault". You have to be responsible for what your door does. If it hits the car next to you, you either parked too close to the line, or didn't pay attention when it swung open.

Agreed. My thought is A is primary, but B should have been looking like hell for the door to fling open.

Neither should pay the other regardless.
