KPRC news article - Jan 4, 2017
quote:

SAN JOSE, Calif. - A Texas couple whose 5-year-old daughter died in a crash involving a driver who was accused of using Apple's FaceTime video chatting app is suing the tech company. The lawsuit filed this month in Santa Clara Superior Court accuses Apple of not implementing iPhone features that would automatically disable FaceTime based on technology that calculates highway speeds.

I suppose that Revlon, MAC and other makeup companies now have targets on their back for any accidents caused by drivers putting on makeup while driving? Holy shite the "you now owe me money for somebody else's mistake" blame game is fricking totally out of control.

The only reason this should upset you is if you facetime while driving.

The issue is that passengers phones would also be disabled. This is ridiculous. The onus is on the driver of the vehicle to be safe when driving. That obviously means not using facetime, texting, drinking alcohol, and many many other things that would cause a driver to get distracted or become incapacitated.

So to extend their argument - lets say while I'm driving I decide to watch a portable DVD player and I get in a crash.

Obviously this would be Sony/Panasonic/etc's fault for not putting a GPS and speed detection to prevent me from being a dumbass.

Sorry I can't see how this lawsuit gets past the front door of the courthouse.

The intent is for it never to get to court, because it would get thrown out. The intent is to be enough of an annoyance for Apple to settle.

that may be their intent, but I'm sure this will get thrown out on an MSJ before it even gets there

shouldnt cost apple a dime since they will be using in house salaried attorneys

people freak out about this shite, but just because a suit is filed doesnt mean the plaintiff will get anything from it, you can sue anyone for anything, its up to the judge to rule if that suit has merit or not

first rule of law suits, you sue everyone. the judge then throws out the parties that are not responsible. i wouldn't be surprised to see CalTrans named in the suit for having an unsafe road, and the local town/county for poor signage. i hate this , but this is the way the US court system works.
