This has been used (fatally) before in a private residence. The homeowner lost in court.

Thanks. It's been a little longer then I thought it was. You filled in some of the blanks I couldn't remember.

No, it was Katko v. Briney. I think they still teach it in law school. The guy lived, but had a really hard life afterwards.
