Reading the thread about the kid carrying the girl to the nurse had me thinking. When did people in this country start becoming so sue happy? What allowed for any offense to be cause for suing?

Cue the "good old days" crowd that longs for a time when your recourse for losing an arm at work was to learn to sweep with one arm.

Say what you want. But it's true. When I was 5 I had the cops called on me for walking through my neighbors yard. And then she proceeded to press charges. That was the beginning of a very lengthy battle with her and my family. For years she would call the cops on us for frivolous things like barking dogs and footballs/basketballs going in her yard.

Bingo. There was a time where attorneys could not advertise. Now, it's hard to go 10 minutes without seeing a plaintiff's lawyer's ad/commercial. Many (not all) of the adds portray filing a lawsuit as akin to winning some kind of grand prize. The least accountable of us are happy to oblige and look at lawsuits a just a way to "earn a living". Plaintiff's attorney's are more than happy to work up even the smallest of injury cases into much larger value cases (including using certain "plaintiff's doctors" who will give any opinion the plaintiff's counsel wants so long as it will help raise the value of the case). Elected judges are beholden to many of the trial attorneys that helped get them elected and it ultimately leads to big business for all.

Don't buy the sob stories that people just want to be "made whole" for their loss. They want to be made rich, and being a plaintiff is potentially an easy, relatively risk-free (for the plaintiff, not his attorney) way to do it.

Yes but what about punitive damages. That has to be a big factor.

and yeah if people think it's crazy now, all the old lawyers tell me it was absolutely insane in the 80s

Very Very uncommon in Louisiana, despite people bitching about it nearly constantly.

Has to do with her being a b****. But the point is she was able to sue for trespassing on a 5 year old kid

I don't see any point in suing if I can't go for punitive damages.

Do insurance companies and industry bear any fault for the current state of affairs?

I feel awful for those poor defense attorneys who can't find a Dr. to give any opinion they want to devalue a case

I feel equally bad about the poor defense attorneys who are unable to participate in campaign donations.
