Shreveport PD makes first arrest under new 'revenge porn' law

It's a woman of all people...
But wait, what was that last part?
That seems like a pretty broad scope. What exactly is or isn't a "private" photo?

SHREVEPORT, La. -Revenge is sweet or so the saying goes. Now revenge could mean jail time.
“These images were never intended to be made public,” Corporal Marcus Hines said.
Hines, with the Shreveport Police Department, is talking about naked photos posted on Facebook by Krystal Holmes, 28. Holmes was arrested Friday and charged with four counts of nonconsensual disclosure of a private image.
But wait, what was that last part?

“This is a very new law,” Cpl. Hines said. “This enacted in 2015.”
Proposed by Representative Julie Stokes, House Bill 489 passed legislation this past Spring.
Starting August 1st, it became illegal to make private photos, public, without consent.

Text of the bill
"Intimate parts" have to be exposed for it to qualify as a crime, intimate parts meaning exactly what you'd expect it to mean under the circumstances.

The blurred images they were showing were of another (?) woman.

I think those pics should definitely be kept from public viewing.

the problem is if you send a person a picture, who then owns that picture?
the person you sent it to or the person that took it?

What if you just sent them to a friend in order to brag with the expressed provision that he not show them to anyone else?

Her faceface page is public and pure comedy gold

What is the letter of the law? Once someone sends it, it is no longer private. A private photo or video would be one that was stolen off of someone's device.
How can the receiving party be obligated to not share without paperwork?
Crazy.

So under this law if a girl sends a picture of her tits to a guy and he shows it to a buddy, the guy is jail eligible?

I would think not.
First the statute says somebody above just linked says that there must be intent to harass or cause emotional distress to the person in the pic. That would be a tough sell if you just showed a pic to a buddy.
Second: the statute defines disclosure (which must occur for the statute to apply) as:
quote:
"Disclosure" means to, electronically or otherwise, transfer, give, provide, distribute, mail, deliver, circulate, publish on the internet, or disseminate by any means.
In other words possession of the photo would have to change hands. At least that is my take on it.

Don't want to watch the video.
Was the pic she posted of a male or female?
if a male, was it posted for all to see so everyone could see how small it was?
