Syed’s case was popularized by the smash hit podcast “Serial,” created by journalists from the “This American Life” public radio broadcast. Since the podcast ended in December, Syed’s case and his efforts to contest his conviction have continued on.

The decision by the Maryland Court of Special Appeals, which was filed Friday, allows Syed’s lawyers to move forward with the appeals process. It overturns a Baltimore circuit court’s decision in January to deny Syed’s motion to appeal his conviction on the grounds that his attorney at the time, Christina Gutierrez, had been ineffective.

Now new evidence could be brought to the surface, thanks in part to the popularity of the radio show.

A former classmate named Asia McClain says she can provide an alibi for Syed at the time of the 1999 murder of his ex-girlfriend, Hae Min Lee. McClain, who did not testify at Syed’s 2000 trial, has said that she would be willing to testify in the case if subpoenaed.

McClain claims in letters that she wrote to Syed in 1999 while he was jailed, and in a new affidavit filed in January, that she remembered speaking to Syed at the public library next to their high school at the time prosecutors said Lee was being slain. After McClain’s affidavit came to light, Syed’s lawyers filed a supplement to their original appeal, requesting that they be allowed to call McClain as a witness.

Are appeals done in front of a jury? I don't see how they could find many who aren't already biased because of serial

I can't speak to Maryland, but appeals are not in front of a jury in LA.

I can't imagine that he's NOT guilty. He's just really charismatic and played ol' girl who did Serial like a fiddle.

Well it was downloaded over 5 million times I believe. And I saw a chart of serial listeners and the majority were in the northeast

But it seems to me like having listened to the podcast would make you question his innocence or at least whether he was given a fair trial and make you much less objective

I lean 95% guilty - I would vote to convict but I also would have said Jay should tried too

You really think the whole investigation and trial were handled properly?

Guilty or not, I don't think the prosecution proved their case and there wasn't enough evidence to convict

I'm familiar with its popularity, but to think a podcast downloaded 5m times will make a decent jury pool infeasible is silly.

I think people underestimate how many people there are in this world, how many don't care about much of anything and wouldn't have run across this podcast.

Actually the more i think about it y'all do have a point. Podcast are still a niche kind of source of entertainment. So it is possible that a number of people on the jury will have no clue about this case.

maybe. Doubtful. Not everyone cares about this stuff. There's a lot of other things that people care about. Like the economy. Or bon jovi. Lord knows I dont follow any local news stories in BR.
