Instead of $5.5 million the judge should order them throats punched and to eat a bag of Di_cks.

Good job by Marrioneaux and Beall.

Surprised Rob took that case. Can't imagine there were deep enough pockets to collect.

He lost control of his truck:

quote:

Leger's blood-alcohol concentration after the crash was 0.10 percent. A blood-alcohol level of 0.08 percent is considered presumptive evidence of drunken driving in Louisiana for those 21 and older.

While over the limit and classified as a DUI.....0.10 is not going to make you lose control of your vehicle.

quote:

Werner said Hall's alleged bumping of Leger's truck was the impetus for the ensuing fatal crash on the other side of the interstate. He also said alcohol didn't seem to be a factor in the incident, noting that Leger performed well in keeping the truck from flipping over after it was allegedly hit by Hall's sport utility vehicle.

Fox concluded that Leger lost control of his pickup after passing Hall on the right shoulder of the interstate. Fox said Leger clipped her SUV as he went around it, then over-corrected and lost control of his truck.

Leger's pregnant wife, Rebecca Leger, testified Wednesday that Hall appeared to be "toying" with them by tailgating them and flashing her headlights at times and hitting her brakes at other times when she was ahead of them. Hall also made angry gestures toward them, she said.

So one of them hit the other causing the guy to lose control and then hit the 3rd car.....I don't see how this is $5 million worth.

It's like "hate crime". People fight every day, but if one's another race then it's a hate crime that shoudl be taken more seriously....If this was just another accident, blown tire caused guy to lose control, there would be no $5 million..

why do we want to look at the "reason" versus just the result?

You serious? 5 people were killed, including 3 under the age of 12.

Um... no shite? He/they likely wouldn't even be found liable in that instance.

5 people burned alive.... 3 small children.... dude. Really? Never mind.... someone always has to be "that" guy. Just pop another beer, go sit in the corner and fulfill your role. Sorry to have called you out. My bad

go check data on the BAC of crashes eading to death.

BAC of single car accidents leading to death is like .16

BAC of multiple car accidents leading to death is like .24

A guy may speed and take a turn to sharp and run into a tree or something.....single car..."liquid courage".

A guy drifts off into another lane head-on collision....multiple car..."drunk as frick"

You realize admitting fault in a civil suit is a bad idea, right?

Did you even read the article? This was road rage gone wrong. You think having "3 or 4" had noting to do with it?

Huh?

It is nothing like a hate crime or a blown tire. Hall served a year in prison for her role, which is absurdly lenient ( Judge Trudy White by the way) and Leger was sentenced to 8 years in prison, at least 3 of which are to be served with no parole, probation, or reduced sentence.

No one.

ETA: For all practical purposes.

And if one admitted fault, the other could move to have their criminal charges vacated, correct?

Curious what kind of insurance policies the two of them had.

Also the article said the punitive damages were set at 100k... wondering if that is combined or for each. I think the guy was the only drunk one so it might just be for him.
