SCOTUS poised to overturn ruling that declares homeless encampments a legal right

The Oregon city of Grants Pass outlaws sleeping in cars parked on the street or in public parks with a blanket, but has no shelter able to accommodate the hundreds of homeless people who live within its limits. The Ninth U.S. Circuit Court of Appeals, whose jurisdiction covers much of the Western U.S., found such measures effectively criminalized homelessness, violating Eighth Amendment precedent that forbids punishing people for their status rather than actions. Under that view, courts in the Ninth Circuit have issued injunctions that limit cities’ enforcement of such ordinances.

But on Monday, members of the Supreme Court’s conservative majority suggested that the Ninth Circuit’s approach, which cities argue has hamstrung their efforts to address homelessness, intruded on the discretion local officials need to govern their communities.


This is good news

Hopefully more cities start cracking down on this tent bullshite. It’s an eyesore to look at.

Imagine being put in jail because you can't afford a home and there is no shelter to house you. Essentially putting people in jail for being poor. I get that alot of those people are drug addicts and the undesirables of society but they are also also of good people down on their luck or who went through the broken foster care system. Idk just doesnt sit right with me locking people up for essentially being poor.

Give them an area to encamp away from the public or fund homeless shelters and then im ok with the law. Having no other option except jail just doesnt seem very humane.

FL anticipated this and has come out gun blazing a couple of weeks ago against encampments and homeless sleeping in public.

There wouldnt be a need for that if the state provided an area for them away from the general public or provide funding to shelters. Im fine with raising my taxes to fund more shelters and mental hospitals.

If you don't have a home, cant afford to patron an establishment to use their restroom, there are no public facilities to use the restroom, and no shelter.... where are you supposed to poop? serious question. Park restroom is my best bet but then again that the state providing those services that I said they should.

The good people down on their luck aren’t spending their days and nights on the streets. They find churches, shelters, and charities to help them. I agree that they are in a bad position and could become one of the “undesirables” of society, but I wouldn’t say that the people making cities unsafe or dirty are those are upstanding people who just need an encampment on public and private property.

My family did just that for a family member when they were homeless during Katrina. Yall aint very christrian to not want to help the poor by funding shelters.

That wouldn't work in the real world though because they want access to drugs/alcohol and people who will give them money. This is also why shelters aren't a real solution, you have to follow rules.

You don't make American citizens fight to keep their citizenship. If you're talking migrants however, I am ALL FOR mandatory military or civil service for two years to earn citizenship.

The crazies that are homeless Americans need to be thrown in newly resurrected looney bins.

This I can understand. Thats why I said that I was ok with the law if they had the ability to go to a shelter. If they choose not to then lock em up. But you cant give them no option except jail.
