Question For Oklahoma Legal Experts

Someone I know wants a divorce from his undiagnosed bi-polar, verbally abusive, unemployed, suicidal wife. Yes, She legitemetly is all of that, no exaggeration. But he travels a lot for work and has a good job, but he is terrified if he files, she will get custody their young kid because of court bias for the mother and his crazy work schedule.

What are his options for a slam dunk win in the divorce and get full custody of the kid?

What kind of recordings are admissible In Oklahoma court? Can third party or someone outside the home record their fights and it be legal?

No she's legitemetely insane, like should be institutionalize, but her family won't do it and he wont do it. He doesn't care about money, he just needs custody for the child's safety and sanity.

Please let your friend know that he is about to go to war. In war, you want to make sure you fire first and often and have the best weapons.

1) get a good family attorney, and by good I don't mean knows the law, I mean knows the judge . In family court there is no jury, therefore Judge = God.
2) file for divorce and immediately file a restraining order . Get the ex-wife kicked out the house . Remember, playing nice means get ready to lose. His goal needs to be to get her living under a bridge. I know this sounds harsh , but again this is war not lovey dovey time.
3) file for full custody . If the wife is homeless , this should be easy.

She's crazy enough to fight him bad, she threatens to take the child all the time. He is a good, decent person who has bent over backwards for years trying to appease her, yet her mental condition gets steadily worse and worse. She is MASSIVELY bi-polar.

I spoke to a lawyer I know recently about it and all he basically said if he has recordings, it's open and shut, he basically can't lose. I don't see it being that easy, but then again he is more of a criminal attorney than divorce, but he's been pactcing at a high level for 30 yrs.

for reason I don't care to discuss I am required to inform you I am no longer allowed to practice law in Oklahoma.

but ol boy needs to get his attorney to petition the court to appoint a guardian ad litem until the mothers mental fitness can be determined if he is sure she is crazy.

Why are people always trying to make things more difficult than they need to be? If the issue is indeed a mental health issue, then why on Earth would he "refuse" to have her institutionalized? Is she taking medication? (Guess not if undiagnosed) If not, why doesn't he get her the treatment she needs?

One poster suggests getting her to live under a bridge. A woman he loved enough to marry and have a child with and now he wants her to suffer as much as possible?

Are people that afraid of the stigma of mental health treatment? They're ready to totally ruin their lives and the lives of their children over it? These aren't mental institutions where they put people in straitjackets, their goal is to get people back to normal lives.

And the fact that this isn't a blatantly course of action is just downright disturbing.

I was almost suicidal due to an OCD that was overpowering. They got me on a medication and I'm a normal productive member of society now.

She has intentionally never seen any kind of therapist or psychologist because she knows it would be bad news for her and be admissible in court that she attended those sessions. She's smart, so smart in fact I think she could fool a psych evaluation. How far would actual, hidden audio recordings go in proving she is crazy.

Holy shite. You aren't that dense are you? Seeing a therapist is an admission that someone is incapable of taking care of a child? Never mind that almost every mental illness is somewhat treatable.

She won't go on medication or accept any kind of help because as I above posted, she knows it will not look good for her in court if divorce proceedings happen. Her family are extremely strange and are literally no help at all. And she has gotten him so terrified that if he does ANYTHING she will take the child and never see him again.

I'm telling you, I have never seen a case like this. I have known crazy bitches, but this one is off the charts and seriously needs help. She will berate him for hours and hours on end because he folded a towel wrong or bought the wrong kind of milk. This will go on until the wee hours of the night most times.

Sounds like she would be easy to set off. Set up a cam in the house and trigger the bitch into doing something insane.

Crazy attracts crazy. I'm sure your friend is a piece of work. If he gets a good enough lawyer they may be able to pin it on the wife.
