Pension to surviving spouse, can you marry someone terminal?

Say person diagnosed with pancreatic 6weeks to live type something, who has kids and a will, but also is not married and has a pension that ends upon death.

Can someone sign a prenuptial and then marry that person and get some of that pension transferred to the "surviving spouse."

Most ERISA plans have a one-year marriage requirement.

Most pension plans have rules stating you have to be married for a certain amount of time before the benefit can be transferred.

Check out the ones that say you lose benefits if you remarry. Never figured that out. It's a retirement plan, not alimony. So why does the survivor getting married have any bearing?

shite, most don't let you change anything about them once you start, much less the ones with a 1-year requirement.

They're funded by an annuity. The annuity is priced and essentially locked up the once the annuitant makes their choice. A single-life annuity will remain a single-life annuity with few exceptions.

This. Also depends on whether they elected to have survivor rights and their beneficiary designation. If they are in pay status, most (almost all) plans will not let you change beneficiaries on survivor rights.

Social Security has a similar statute (I think it's three years), just in case this broad was over 65 and that was your backup plan.

Is this person retired? I just got laid off and I transferred my pension to an IRA.

It is my understanding that you have to set it up prior to retiring, atleast in some states. See what Pat Summit & Joe Paterno did knowing their health issues.
