Will have to report for resentencing

quote:

South Africa's Supreme Court of Appeal ruled that the lower court did not correctly apply the rule of dolus eventualis - whether Pistorius knew that a death would be a likely result of his actions.

Reading the ruling reached by a panel of five judges, Justice Lorimer Leach said that having armed himself with a high-calibre weapon, Pistorius must have foreseen that whoever was behind the door might die.

Pistorius' lawyer argued that he believed that there was an intruder in the house but the judge said that the identity of the person behind the door was irrelevant.

What a fricked up justice system, how can you be resentenced after you've been convicted and served time?

That is insane, especially for RSA. So there is no defense for self-defense in a country as crime-ridden as RSA?

It was a sham he got off. He obviously murdered her in a steroid rage.

Our rule against double jeopardy is actually not all that common in the world. Look at the Amanda Knox legal fiasco in Italy.

But frick Oscar anyway. Maybe he should have known that RSA had a fricked up legal system before he decided to murder his girlfriend.

Guys, you are misunderstanding me. I know Pistorius is guilty and the break-in story was a lie, but the way that I understood what the judge said was if you end the life of anyone, it's a murder.

I think the judge was indicating he should have made some attempt to determine who was behind the door and/or fire a warning shot before firing blindly into the bathroom at point blank range.

That's what a normal person would have likely done.

I was wondering the same. Oh well, he deserves death as it is, maybe he will just off himself.

That he made no attempt to find out who was in the bathroom (like his girlfriend never goes?), he fired several shots (indicates rage), the evidence says to me he intentionally shot his girlfriend.

Personally, I wish the US Justice System had the ability (or the balls) to act as such. The fact that a person who is obviously guilty of a crime can be found innocent simply because of a technicality such as a glitch in the documentation of means of obtaining evidence is complete bullshite.

1) Juries are comprised of people too stupid to get out of jury duty. That we put so much responsibility on their shoulders is troubling.
2) When you see injustices such as Casey Anthony walking around free, it is absolutely frustrating.
3) We simply have too many criminals and too much crime to do anything like this. In all actuality if someone is let go they usually frick up again so it all works out. See: OJ.
