If they're not using on the job I don't see why you'd be any more worried about them than someone who likes to have drink alcohol on their off time.

My pre-employment drug screen for my new job in Denver tested for weed. 5 panel test though so smoking a little weed would have cost me the job but I could eat xanax, or any other benzo, every day and be good to go. That just doesn't make much sense to me personally. I'll take the smoker over the pill head any day

Me too.

I'd probably take the smoker over a functional drunk.

Actually.....the greatest concern a marijuana user should have is the increase in probability they are involved in an accident. That is the most well established risk associated with use.......after the munchies and paranoia.

Can I weed out pot users as potential employee because I don't feel that they would be 100% safety conscience operating heavy machinery?

Keep in mind not discriminate, just weed them out.

If you have to repeat your joke for clarity, it wasn't that funny in the first place

ISWYDT, and yes, that would be entirely legal, just like saying your employees can't be drunk on the job or smoking cigarettes around customers.

If a bad seed rolls up into your joint, particularly a doobieous one, you should toke every opportunity to smoke it out, lest you suffer chronic laziness in the workplace.
