As the guy who started the Trayvon's thread so long ago, I find it fitting to close this story out.

DOJ announces it will not file charges against Zimmerman in Martin shooting

quote:

The Justice Department announced Tuesday it will not file federal civil rights charges against George Zimmerman, the Florida man who was acquitted last year of second-degree murder for shooting Trayvon Martin, an unarmed black teenager.

quote:

“Though a comprehensive investigation found that the high standard for a federal hate crime prosecution cannot be met under the circumstances here, this young man’s premature death necessitates that we continue the dialogue and be unafraid of confronting the issues and tensions his passing brought to the surface,” Attorney General Eric Holder said in written statement. “We, as a nation, must take concrete steps to ensure that such incidents do not occur in the future.”

I wonder if he means the incidents where dudes jump on a guy and pound his head into the concrete?
quote:

Thursday marks the third anniversary of Martin’s death.

Federal charges are much more difficult for this type of offense then state charges.

Thank God. The guy seems like a real assclown but it's idiotic that they even thought about federal charges.

I reiterate that hate crimes are bullshite. All crimes are hate crimes. While a mens rea is valid inquiry, particularly in making distinctions between "honest mistake" and legitimate criminal activity, as well as between various grades of homicide, "manslaughter", "second degree murder", "first degree murder", etc., delving into the "motivation" of a crime seems dangerously in the thought police area.

While it might be helpful to a jury to establish the defendant indeed had a reason to commit the crime, to use the varying motivations to establish a crime or (even worse, in many respects) to elevate the penalties seems the height of thought police.

For example, the James Byrd dragging - I don't care why the yahoos targeted - whether or not his shirt was untucked, he looked too tall for his weight or he was wearing a Longhorns cap - once they decided to drag him to his death, they're animals worthy of being put down. I don't want to get into the fact he may have been targeted because of his race, because that just reinforces the fact that blacks are different and need "special" protection.

Everyone deserves equal protection under the law in our system or it won't work.

The tragedy of the Martin shooting is that it was so preventable - if the 2 men had communicated openly, honestly - neither would have been much troubled. But because they both feared and suspected each other, the conflict ended in the tragic death of a young person - a tragic, avoidable death.

But I remain unconvinced of any criminal activity on the part of Zimmerman - the first "white hispanic" in U.S. history.
