It apparently worked.

You called the cops and bitched to the OT.

Neighbor didn't even have to say a word.

you did right by reporting it, you just left out the why there are issues

Back story is that moved from out of state to house he inherited and has been a total dick from day one.

--------------------------

He inherited a house from a relative that passed away. Truly no real story to tell. He has been just a arse up until this point. I was told that he had a dislike for my family and really that is all I know m

--------------------------

I don't just go around calling the cops you fricking dick. I only did so after his comments about brandishing the weapon. Maybe in your area it is a normal way of life to do such, but for me it was a first.

---------------------------

so, you got nothin...it's like pulling teeth to get info from you

-----------------------------

No he was a great old guy. World War I I vet. We would help him out, do yard work and keep an eye on him.
I never knew that the man who moved in even existed until he moved in.

------------------------

U. S. ARMY Combat engineer, did Operation Just Cause in December of 1989 and followed that up with Desert Shield and Desert Storm in 1990 and 1991.
So yeah I get the homoish pussy style living comments often.

your service is irrelevant, your inability to communicate is what is relevant

3 pages of this crap, and you said virtually nothing...no case, now 6

unable to communicate...

He is just letting you know he is the new alpha male in the neighborhood and putting you in your place. Don't be surprised when you come home from work one day and he is stirring your wife's guts for her. She will be attracted to him.

He probably already is. Also, I'm thinking OP probably didn't see him pissing on his house before he drove up.

I'll tell you that no ADA in his right mind would attempt to prosecute a person for placing his hand on a holstered gun. It's not a crime. While the OP wont' answer anyone's question as to whether or not the weapon was drawn (and we all know why), there's a reason why the "police have done nothing."

This absolutely false. I've worked as a DA and assault charges brought for exactly this type of thing if there is sufficient history and surrounding facts.

I mean this may not be that case, but you assertion that this would never happen is stupid.

Great! So have I, in the highest volume parish in the state.

Why don't you go ahead and give us the names of some of these defendants you've brought charges against, since "holster" doesn't appear a single time in the notes of decisions in this 20+ year old statute....nor is there any single decision wherein the apprehension element was deemed satisfied by placing one's hand on a holster, or even picking up a gun. In fact, there are several decisions which surround and debate the fact of whether or not actually pointing a gun at a person was sufficient to infer apprehension, and one where it was specifically found to be insufficient, as the victim didn't actually believe "he had the guts to pull the trigger."

I'll wait.

Don't you think the op would have added all the history if it exists?

Here's what we know...the NEW neighbor touched somewhere around where a gun could be located. We don't even know if the gun was showing.

The biggest leap I can make, at this time, is that the neighbor might have lifted his shirt to expose his weapon.

He could also be charged with arson if he was there to distract the driver while his friend threw a molotov cocktail at the car.

My neighbor is much the same. He's a half crazy retired cop and always has that look, regardless of the situation or who he's interacting with. And he's always packing.

Get to know the old guy, he may be pretty cool. I never worry about anyone messing around the house when I'm gone. He's like the unofficial neighborhood watchman.

Maybe you look sketchy or drive too damn fast down the street and he's just silently judging you, while wondering if he should fear for his life. Slow down, get a haircut, turn the music down, be a decent neighbor and introduce yourself and you might be alright.

But go meet him armed just in case, and make sure he sees your weapon.

I've got a dollar that says he wasn't the elected DA of a district.

He was a DA? So he was elected to office?

I asked him to support his claims. I can tell you that West doesn't know about them. I'm just merely using that thing we call "law."

Eta: most ADAs in Orleans have tried more cases in a year than other elected DAs have in a lifetime. Oh, and with the toughest jury pools in the state.

So if I walk to my car, in the driveway, with a gun I am a criminal in Orleans parish?

Absolutely not, unless you're a Felon and assuming you're "walking to your car with the gun". But under the logic of Corporate Tiger, "you'd need to look at the facts and history."

I know of someone in Ascension Parish that was arrested for walking around his property with a shotgun.

He never pointed it at anyone, but had fired it off before and assaulted the neighbors with it and other weapons.
