That's my point. the LT said he calibrated it at 4:30 where I know it doesn't need to be calibrated.

if anyone in the history of the world ever over thought a simple speeding ticket, they never over thought it as much as you. just pay the fricking ticket. if you haven't had one in a while, it wont affect your insurance anyway.

I am not going in court and say I was speeding. That's idiotic. I am just going to invoke my 5th amendment when they start asking how fast I was going. My argument is that he did not measure my speed correctly. I am just casting doubt on his evidence.

So you think you are going to get to tell your side of the story, and when the tough question comes, you just shut up?

I was hoping that the fact he filled the ticket incorrectly would demonstrate his inability to record data. Again, I just want to cast doubt, not to prove I was not speeding.

Just because people think technology is infallible and untouchable that they should take it like a man? Nope, I thought I could fight this because of this scenario. Paying 250 dollars for 80 mph which is 10+ over the speed limit which I was not in the 80 mph when he lasered me.

The only thing you have going for you is the distance. Some states have a max distance that they will "allow" in court because the beam gets larger the further out it goes. They will still hope you just pay up and don't fight the ticket.

I'm in the same boat as you. I am fighting ab instant-on ticket right now. When I was going to enter a plea, the assistant prosecutor was incredibly insistent on me just paying the fine to keep it off of my record. He asked me if I wanted to 6 times in our 4 minute conversation. I told him I was definitely fighting it and that we would see what went on once I file for discovery.

I speed 99.99% of the time, but I knew he was there so I slowed down. I plan on wasting as much of these frickers time as I can over a simple traffic ticket just to prove a point. Sure I could call and ask them to just drop it, but I wouldn't have gotten my point across then, and I wouldn't be able to see the cop get angry because he lost

I have fought 4 tickets before, and won every case. It is a major PITA, but I like pissing people off who are trying to screw me out of money.

It's incredible how this board is filled with so many trashy poors who speed and then rage and come up with nutty theories and defenses when they get caught.

The point is: that's not how it works Ms. Lerner.

He could write the ticket in crayon and it wouldn't matter. In a speeding case, the cop is always going to be the more credible party.

You aren't going to win this thing in court. Try to get it changed to a non-moving violation.

This thread is great. We have a guy who admits he was speeding, but wants to fight it for frivolous reasons, and we have a real Jack McCoy in traffic court.

Your an idiot if you think your going to just invoke when they ask the questions you don't want to answer. As a defendant you either invoke altogether or waive your right to silence. The second you begin to answer any question in court you have waived because the state has the right to cross. You'll be held in contempt if you refuse to answer at that point.

I am not fighting for frivolous reasons. I thought I saw a hole that I could exploit. Who wouldn't want to have it thrown out instead of paying money for it. That's why I came here to look for some perspective.

Good point. I wasn't planning to invoke it right away per se. I just wanted to shift the focus on the trooper who took down inaccurate data who took a real scientific technology and abused it.
