Is a bar considered a "public place"? Even if it were privately owned?

If its a place where members of the public "could" or "do" gather.... then it is in fact public.

"Public place" means any place to which the public or a substantial group of the public has access and includes, but is not limited to, streets, highways, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities, and shops.

If it goes viral, whoever's in the video is going to have a really hard time bringing litigation on thousands of people but can for the initial person who broke it out should they be able to prove it, probably via electronic means. I think for slander, or defamation of character.. ask an OT lawyer prob one around here
