Legal Help Needed - Will & Trust Dispute - Possible Eviction!

Hello Everyone,

I am a long time lurker of this forum. Been lurking for a year or so. I live in Houston, TX. I have gotten myself into a jam that I can't fix on my own. Just looking for some friendly advice. Thank you in advance.

I have an issue with my Trustee that is about to get me evicted from my apartment.

Long story short...

Father passed in 2015. I was left an inheritance. Not millions. Enough to help me pay some bills for awhile. My cousin was made the Trustee. His career, Will & Trust Lawyer. That is why my father picked him I guess.

From 2015 to present, I have had nothing but problems with him. Last month, I filed a state grievance against him for failing to do his duties as my Trustee. The state denied my claim for lack of evidence.

I am a felon. I was convicted in 1987 of a non-violent burglary of a habitation. First and only offense. I'm not that person anymore. I was sentenced to six years. My cousin is trying to take advantage of this.

Anyway, It is still a challenge for me to get approved for apartments even 30 years later. I finally found an apartment who would let me move in under one condition.

1) My Trustee will be responsible for paying my rent. He is in charge of the money.

He agreed. I agreed. The apartments agreed. I moved in.

For the first four months, he paid the rent late making me pay all the late fees with my money.

This month, because of the grievance I filed, he is now refusing to pay any of my rent. Retaliating against me for the grievance I filed. I can't pay the rent he agreed to pay without my money from the inheritance.

I can answer any questions. It's a lot to type.

Get a lawyer

eta: you're at least 47 yeas old and can't pay rent? You can just pay it now and work out repayment later to avoid the late fees.

Yes. I have I a job. The money from that job pays the other bills.

This was an agreement that the inheritance money would be used for my rent.

Can you find an attorney that will do free consultations? That's your best bet.

Was your cousin part of the lease you signed for the apartment? Is it written anywhere with both your and your cousin's signatures that the trust would pay your rent?

Where did you live and how did you survive before your father passed in 2015? 1987 was thirty years ago...you’ve gotta be, what, 50 or so?

From having seen several of these things up close, IYAM it's better to have a disinterested third party administrator/executor/trustee.

Because he is Will & Trust attorney and figured he wouldn't screw me over. I don't know why my father picked him to be honest. I can only speculate.

You'd probably do much better posting an email address. On the off chance that a lawyer reads this and is inclined to help you, they will be much more willing to do so through private email or phone conversation than over a public message board. That is my non-legal advice.

So you just laid back on a safety net instead of making your own money?

What happens when the inheritance is all gone?
