They aren't going to evict him because no one is going to rent it until the air is fixed. So they might as well just fix it for him and not go through the added hassle of evicting him and having to fix it anyway plus lose rent $ while they look for s new tenant.

They just need the proper motivation.

I would either do that or have it fixed and deduct that from the rent.

I had to do the latter once when the water heater busted at a house I rented and I couldn't get the landlady to answer her phone and I wasn't going to go without hot water. I had already missed a day of work to clean it up (thankfully it happened before I left for work) plus the actual work of cleaning it up.

She bitched a little bit about it at first until I reminded her that I was the one who cleaned it up, missed work $$ so she didn't have to (plus she lived 60+ miles away) and called around to find someone who had the correct type water heater (old lake house that had a countertop water heater). Then arranged it all saving her the hassle. She shut up pretty quickly.

You don't have to eat shite if you're a good tenant who pays his rent on time and takes care of the place. Landlords don't want to miss out on any rent they don't have to plus risk getting a new tenant who might not be as good as the current one. The odds were highly against her upgrading renters and she knew that.

Edit: Granted this was renting from an individual and not some corporate group. I always try to do business of any kind with individuals or mom and pop stores because they're easier to reason with than corporate places.

There is a big difference in rental enforcement between an apartment complex management company and a private owner.

In a private owner situation like yours, you did the right thing. Professional management companies will squash you like a bug in court.

I've seen it happen. Lease signed says you can't withhold rent for maintenance concerns. Actually had it happen last month (though not ac related and issue not even turned into the office until the residents were mad they had to buy out to leave). I've seen many people shoot themselves in the foot over it. Much better to pay the rent but go to a higher person and keep pushing for rent concessions.

If a private owner, you are probably right, but big companies most certainly will evict.

I couldn't disagree more.

My last apartment had AC issues for a few days. Turns out the entire unit needed to be replaced. I had kept it running for the first couple days, and temp would not get below the low 80's.

On the last night, it was turned off completely. That night was one of the hottest it's ever been inside of a living space for me. Next day, temps got into the mid 90's inside the house without it running. Miserable.

Granted, my landlord was awesome and fixed it immediately when she found out we needed an entirely new unit/system inside the house.

Grass clippings sucked into the unit. Take the covers off and clean the grass off so the unit can breathe. Happens to a lot of ppl in the summer who run their unit while their grass is being cut. Problem should be solved.

I had a similar problem as the OP and thought it was because the shite that comes off the cotton wood trees had clogged up the outside of the unit and it couldn't "breathe". I took the cover off and cleaned all that bullshite out and it still wasn't cooling. It just needed to be charged with freon and was fine.

I had it happen again the following Summmer and was pissed because I thought it had leaked and would need to be recharged again. Went thru the same process with the cotton wood bullshite on the until to make sure that wasn't it this time (plus that crap needs to be cleaned off every year anyway) but this time before I called to have it recharged I just flipped my breaker to the unit off for 5 min and then back on and it has been cooling ever since.

Point is there's no way in hell to know what the problem is based on a message board post. While cleaning the unit is always a good idea, it could literally be anything from that, to freon, thermostat, to needing a new unit.

BTW, cotton wood trees suck arse. For the two weeks a year in the Spring when they're " blooming" or whatever, it looks like it has snowed and that shite gets everywhere. It makes pollen look like manna from heaven.

Well then, I would run that ducking unit till it blew up. Let it run and makebdamn sure compressor is on. Especially when the Freon is low.

Also, I would call them and knock on the door 10 times a day until they came over to fix. They would beg me to come fix it!

I agree. I was just thinking, I don't believe I have ever rented from a corporate overlord. Even while in college I picked out a property rented by an individual.
