Agree. At best it seems to be a sexist statement by a coworker. And he didn't apologize but he didn't do it again.

My friend was told she's not getting a promotion for how she looks/doesn't dress the part

She's a hippie from the west coast if that tells you anything. I thought that was fricked up

She should address the issue with the person who offended her. Is this a construction field type of job? Because that is male dominated, right or wrong, she could be blackballed or labeled as a difficult person to work with if she goes to HR.

Depends on how it's done "you look like shite, no you're not getting promoted" and " you don't project yourself in a professional manner that allows the company to consider you for a management position as this point and time" are very different.

If that's all there is to the story; this was a one-time deal that was not done in front of other employees; there was no quid-pro-quo; that he isn't her supervisor; and she wasn't denied a promotion or put at a significant disadvantage because of these actions, then he probably is okay, for now, though he has a strike against him on the "harassing atmosphere" component, so he should keep his mouth shut from now on.

Yea that's all there is. She should just blow it off and be happy kicking his butt at their job. I know we can be fired for saying stuff like that at my job. Even if it's one time.

I believe LA is a right to work/no cause state, right? In that case, management could decide that even if his activities aren't actionable, as an employee he's not more valuable than the cost of defending the suit.

Sounds like some job in the construction field, if so tell her to keep doing her job above and beyond and she'll get what she earns. The biggest problem i've seen with women in project management positions in construction is a lot of the workers don't respect them and they really have to prove they know wtf they are doing and aren't afraid to stand up and tell some idiot sub to stfu and do it right.

What happened to Mike's friend is more wrong than what you describe here. Part of a job title is to dress respectable. There's no law against that.
