But isn't proving it the problem here? From what I recall of this, you have to basically have video of them banging to have proof.

Anything less, such as staying in the same hotel room and hearing moans from outside, doesn't count.

BTW (not directed at you of course) The soon to be divorcee is the one who is getting an advantage in the community property split due to his wife making more than him.

It was the result of a very good attorney, and her being very agreeable so she could marry her new man before she had his baby. She literally left the courtroom and went upstairs to get their marriage license. My attorney and I knew we got lucky as hell.

I thought it was against statute to negotiate less than the mandatory minimum child support?

*I don't practice family law, I'm just fishing up memories from two bar exams.

i think that's the issue of getting the "cheating" divorce avenue (103). you basically can waive the time delays but courts hate this so they make you super duper prove adultery. some will simply refuse to allow it altogether (even if they both admit it). it's the damndest thing

he's in TX and you can get around this in all sorts of ways if the parties agree

in LA, i've done plenty where the parties agree to decide it among themselves and the judge let me get away with it. i have some special language for it

I'm not sure how they did it, but she agreed to it. Let's just say, I had plenty of I wanted to really hammer her for full custody. Instead we settled with 50/50, no child support and me having the domicilliary tag.

Ya, I remember that being mentioned or something during prep. It is pretty ridiculous.

well that is big. if TX is anything like LA, then that's why you can pay nothing without issue

*ETA: nm. that is why

quote:

D. The party without legal custody or nondomiciliary party shall owe his or her total child support obligation as a money judgment of child support to the custodial or domiciliary party, minus any court-ordered direct payments made on behalf of the child for work-related net child care costs, health insurance premiums, extraordinary medical expenses, or extraordinary expenses provided as adjustments to the schedule.

when i first went out on my own (2013) i started doing family and i did one and got the judgment (my client was the cheater but both wanted the divorce) and the other lawyers kept asking me what i did behind closed doors to the judge to get that judgment. i had no clue it was that big of a deal

Sure, if you know how to hide it from her and the attorneys.

That's a good story to have in that line of work.

I see you said his having domiciliary custody is the difference. That makes sense to me and sounds vaguely familiar.

Man I can remember when all of that went down and before the divorce happened when you were sincerely trying to give it 110% to save your marriage with her. Sounds like you dodged a huge bullet and came out looking like the better person in the process. Meanwhile your ex went all downward spiral.

Goes to show good guys can win after all

My divorce cost me $350

I got the house, the nicer car, 50/50 custody, no child support, no alimony.

It helps if your ex isn't a bitch and isn't trying to ruin your life

Yeah that was a rough time. I know I had to go through it to be who I am today, but shite, I just wish I'd have gotten to the other side a little quicker.
