Is There a More Abominable Crime Less Penalized than DWI?

Everyone knows that even for a 3rd offense DWI hardly anyone gets the maximum sentence. This is egregious. The base sentence for a first time DWI should be a felony; one to five years imprisonment with or without hard labor, one year to be served without suspension of sentence; $5000 fine; 90 days of community service; two year suspension of drivers license; inpatient treatment for 3 months with outpatient for 6; Probation for 10 years to include monitoring devices for 1yr; Seizure and sale of vehicle.

We are not tough enough on DWI. DWI is one of the top public safety concerns.


Below are the current sentences...

Up to six months imprisonment or a fine of $300 to $1,000
48 hours in jail
Up to two years probation (depending on the court)
About 30 hours of re-education involving mandatory attendance and completion of three courses in substance abuse, driver improvement, and a MADD victims impact program
Plus at least 32 hours of community service, half of which must be garbage pickup on the street
Special penalty requirements for 1st-time DWI:

If the BAC is over .15, then an additional 48 hours of the jail sentence cannot be suspended.
If the BAC is over .20, then 48 hours of mandatory jail, plus a fine of $750 to $1,000, and an ignition interlock device must be installed for a period of 12 months.
If a violation of the child endangerment law has occurred, certain of the jail sentences cannot be suspended.

The prosecutor may seize the offender’s vehicle and sell it, if he chooses.
If sentence is imposed under the child endangerment law, then one year of the jail sentence cannot be suspended.
An ignition interlock on all vehicles driven by the offender shall be required.

Home incarceration for at least one year Probation
Electronic monitoring
Seizure of the vehicle the offender was driving

Additional penalties are imposed if there was a violation of the child endangerment law.

Breathalyzers are incredibly flawed and police officers usually conduct filed sobriety tests incorrectly.

Compound that with your case going before a municipal judge who probably doesn't have a law degree and I say lots of people get convicted of DUI's when they shouldn't have.

Lobbyists are the reason

Also the ones who write the laws(politicians) are more likely to drive drunk than normal citizens so they aren't going to write laws to punish themselves harder

I think that is way too light. We should probably execute the perpetrator and their entire family. Like with treason, DWI is in the blood. We should make sure their kind no longer exist.

Actually, i think DWI are now pretty rough. Back in the day, ur lawyer could get a hold of it before it went to state and then deal with DA.

I had a buddy, who's brother had 16 dwi's.

then when they went to new laws and penalties, he got one 5 years later and did a full year in jail.


Now, if you said the laws on Killing some one while drinking n driving were lax and ridiculous, then i 100000000% agree. 2 guys from my high school, got drunk and killed a construction worker a few years after turning 21, and neither did more than the Jail time they sat, till being bonded out.

All ended up with Probation

I am guessing most of the people who think DUI is no big deal have never been affected by it

When you have someone you care about ejected from the front seat of a vehicle through the windshield 40 feet in the air in the street, and have to watch them get airlifted by chopper to a brain surgeon to save their life, while the other 2 people in the vehicle are killed on impact, you will view it differently
