We’ve been blessed to go through life without an accident but recently my wife (no pics) was rear-ended (not sexually). Insurance company’s preferred body shop was extremely busy so they said we could use one of our choosing. We chose a reputable shop here in this area and after the insurance company sent the claim we brought our vehicle to the shop.
I’m guessing the shop sent in a supplement for something additional because A week later we get a call from the insurance adjuster saying that they were having trouble coming to a resolution with the shop on the repairs. He stated that we would have to come out of pocket for a portion of the repairs $900. My wife proceeded to tell him we aren’t paying a dime and we want to be made whole.
Is this typical insurance run around or should we reach out to an attorney?

Some body shops are like the billboard attorneys of car repair. They’ll claims all sorts of things are crash related to pad the bill. The insurance company probably isn’t just randomly denying it, they question how such a part was damaged in your specific collision. What’s the part?

Yes, very common. Usually the body shop adjuster will go back and forth with the insurer and get them pay in the end. Talk to the body shop and see what they recommend. If the body shop gives up on arguing with the insurer, you don't necessarily need an attorney, there are independent adjusters who live for fighting with insurance companies.

Who is the insurance company?

Is it your insurer or the person who hit you?

USAA

USAA is usually good about paying, this may be on the body shop.

Good for her. I wouldn’t pay a penny for damages someone else caused either. What the hell’s the point of insurance?

This has been my experience with USAA. They've been fair, and actually kind of generous, with payments on the claims I've had with them. I've had to answer a few questions or provide more info but haven't had them deny a legitimate cost. Sounds like the shop is trying to be slick and the adjuster's staying ahead of them.

you'll have to provide a retainer. that will be more than 900. if they can't resolve it. call the corporate office every day for 3 or 4 days. you will get things resolved. I know from experience.

also find out what they can't agree on.

That’s rich. If I were the OP, I’d run it through my own insurance.

USAA may be good on first party property damage claims but they will frick you all day on third party claims.

None if this is to be construed as legal advice.

Don't forget to file your claim for diminished value once the repairs are done.

You'll take a hit on the trade-in or resale value because of the accident history. If the other party was at-fault and their insurance is paying, they owe you for the difference in value.

Supplemental additions to a claim are common. It's hard to know what all is damaged until the mechanics and body folks get in there and start working. USAA needs to fix the vehicle in full. You'll have to stay on them to get it done but usually if you don't roll over they'll end up paying it.

Make a claim for loss of use of the vehicle and log the days you can't use or don't have your vehicle.

I own a bodyshop, not in your area. I deal with USAA on an almost daily basis. I'm also not a USAA "preferred" shop. I have never had an issue with them paying for something that is accident related. This is very likely on the bodyshop. Like a poster said above, there are some shops out there that are just like the billboard attorneys, trying to screw the insurance companies any chance they get. Don't get me wrong, some insurance companies are harder to deal with than others. But, I have never had an issue with USAA.

Have they told you specifically what’s in dispute? (Part prices, labor rates etc)

My wife didn’t get those important details during her tirade yesterday. I’ll be calling them shortly.
