Yeah but this time upgrading is different because of all the phone companies going away from the usual 2 year contract, plus having other options (Apple upgrade plan, etc). AT&T is pushing customers hard to get on another plan and off unlimited. I've always specified in the past that I wanted to upgrade and not lose my unlimited plan.

They continue to call and e-mail me, alternating between the carrot and the stick approach to take away my unlimited data. I've learned that bringing up the lawsuit generally cools their zeal a great deal.
