Eh Wah had been on the road for 12 hours when he saw the flashing lights in his rear-view mirror.

The 40-year-old Texas man, a refugee from Burma who became a U.S. citizen more than a decade ago, was heading home to Dallas to check on his family. He was on a break from touring the country for months as a volunteer manager for the Klo & Kweh Music Team, a Christian rock ensemble from Burma, also known as Myanmar. The group was touring the United States to raise funds for a Christian college in Burma and an orphanage in Thailand.

quote:

The sheriff's deputies in Muskogee County, Okla., pulled Eh Wah over for a broken tail light about 6:30 p.m. on Feb. 27. The deputies started asking questions — a lot of them. And at some point, they brought out a drug-sniffing dog, which alerted on the car. That's when they found the cash, according to the deputy's affidavit.

quote:

The deputies found $53,000 in cash in Eh Wah's car that night. Muskogee County Sheriff Charles Pearson said he couldn't comment on the particulars of Eh Wah's case because of the open investigation, but it is clear fromhis deputy's affidavit that the officers didn't like Eh Wah's explanation

quote:

officers ended up taking all of the money — all $53,249 of it. "Possession of drug proceeds," the property receiptreads. But they let Eh Wah go. They didn't charge him with a crime that night, instead sending him back on the road about 12:30 a.m., with the broken tail light.

quote:

County authorities eventually charged Eh Wah with a crime, five weeks after he was stopped. They issued a warrant for his arrest April 5, for the crime of "acquir[ing] proceeds from drug activity, a felony." For probable cause, the authorities noted the positive alert from the drug dog, "inconsistent stories" and said Eh Wah was "unable to confirm the money was his."

Mr Eh Wah just learned how much it costs to be protected and served. Personally my favorite part of this is the criminal charges that will be dropped once he waives his rights to the money. This is literal highway robbery.

ETA- if it wasn't clear from the excerpts, no drugs or paraphanalia were found. .

This type of bullshite should make any American's blood just fricking boil. It's nothing more than legalized highway robbery, armed robbery in fact. Armed robbery by the state that shits all over the Constitution.

I'm all for throwing every copy that perpetrates this and every lawmaker who ok's it in jail. It's outright robbery plain and simple.

Seems like he has some good attorneys working for him. Very smart to go to the press for this as well.

On a serious note, this is pretty pathetic. I've argued in these threads that there is no good reason to have $53k in cash sitting round in your vehicle - and this is a perfect example of why you shouldn't have it - but it doesn't make it right in the slightest. Very few good things can come from holding that much stuff in cash and unfortunately you're just asking for trouble.

ETA: Apparently people have a hard time with reading comprehension. Even the most innocent of intentions can get you screwed with civil asset forfeiture laws set up the way they are. Knowing how the law can work against you in these cases, there are few reasons you should knowingly carry that kind of cash with you. They can and will steal it, so don't do it. It doesn't make it any less despicable on their part, but they can't take your cash if you don't have any cash in your vehicle. Why risk it until the laws are changed?

This has everything to do with State and local politicians, and finding ways to steal money from their people, on the basis of trying to stop drugs and drug money. They use the Police as their collectors, and thus all the heat comes on Cops, not at the politicians who push this.

Car buyers and buyers of antique collectibles often carry large amounts of cash for buying. Cash gets them better deals.

Sure he was.

I'm glad they took it. Sounds like his conflicting stories indicate he was doing something. And we sure don't have any Christians named Eh Wah in my church.

Hope they lock him up.

You're pretty naïve if you think only drug dealers carry large amounts of cash.

My point is that this is the kind of shite that can happen to you. I understand there are plenty of perfectly legal reasons to have it, but the bad things that can happen outweigh the good. This isn't his fault by any means, but when the laws are set up like this, you can get screwed with minimal effort.

To put it another way - knowing how the law reads and works against you with CAF, there are little to no reasons you should carry cash in these amounts. Until the law is changed you're fricked.

Many who carry cash like that, and visit states who try to steal cash on their peoples, will receipt it up. They will make sure they have a receipt for why and how much of the cash they have.

Knew a guy who bought older vehicles and restored them. he always had documentation of the cash he had on him. He said, he had gone through a bopunk Mayor and PD try to steal his cash over a bogus traffic ticket. Said he was Bosshog 2.0. Once his lawyer got state and fbi involved, things changed and his cash was returned.

Never said that whatsoever. This guy got robbed basically, but this is a much bigger spin on why I won't carry more than $200 in my wallet either. I can cancel cards, but the cash is gone if someone takes it - the police or a thug, it is getting difficult to tell one from the other.
