Homebuyers backed out. Seeking advice.

Closing date is set for next week. All conditions met. He emailed me saying he and his girl got in a fight and are backing out.
Any OT real estate lawyers out there who could guide me in the right direction? Worth it to put the heat on them?

UPDATE: The sale is back on. Friday can't get here soon enough.

usually there's a period that once it passes you get to keep the deposit, was that not in your contract?

If they gave a deposit, keep it. Outside of that, I don't think there's a lot you can do.

I kept the earnest money. The people I'm buying from already started moving out of their home. It's put everyone in a bind.
Don't really live in HT. I have a camp there.

He could turn around and sell for a 20k profit. It could just be a good investment.

Sounds like it's a huge win for you then. You got free money and can sell it for 20k more than you were about to sell it for.

The standard LA contract states that if any party backs out without cause the other is entitled to 10% of the contract price or specific performance (force them to close)

Read the purchase agreement. .

I agree you should burn the house down for the insurance money. But just to be safe burn the house down on either side of you to cover your tracks

This happened to a friend of mine recently. Parents died and he had to sell the house.

Finally had a buyer. Met all conditions the buyer asked and backed out before closing. Went around asking what could he do and was informed that he should hire an attorney and threaten to sue. Attorney sent paperwork. Buyers eventually bought the house.

What advice do you want here? Keep the Earnest money. They caused you to lose at least a month of mortgage and a bunch of your time, furthermore you need to teach them a lesson that you don't freaking buy a house with a boyfriend or girlfriend. One side buys it and the other lives there.

The girlfriend backed out of the trade deal of "buy me a house and you get anal sex". See if your wife can make the same trade deal of "buy my house for anal sex".

Had that sort of thing happen to me on my house in TX. If you are close to closing you must have a contract. You can request them pay you a fee for backing out or just let them off the hook if you want. I charge the guy 5k to break the contract because I had taken a week off of work to move my shite out.

If only you had a real estate agent that could take care of this for you...oh wait a minute. Everyone on the OT is smarter than real estate agents and don't need them.
