Agreed, but it doesn't mean that the charges need to be misapplied. He will face some serious charges anyways.

The guy that died was 58.

He looks much younger in that video, at least to me. Maybe it's the lanyard.

A) Why would you seem surprised that I never took karate?

B) Most people would assume that he wasn't trying to inflict "serious" harm on the guy. Everyone was stunned that the guy had a glass jaw. It wasn't an open palm, it was a back hand. I could see an upward thrust with an open palm inflicting that kind of blow, but not a back hand.

He wasn't physically provoked AT ALL, and he SPRINTED away. What does that tell you? Why would he SPRINT away? If it was a self-defense thing and he felt that way, then I doubt he'd bolt like gang busters out of there like he did. He knew the guy wasnt ready, and you can plainly see he wasnt in a fighting mode, and the guy took full advantage. It wasnt self-defense clearly, so what do you call it?

A recent case of dui manslaughter in Florida, the guy got 15 years. He didn't mean to hurt no one.
See how that works for your argument?

Why cant a backhand be just as lethal? It was his best possible route to inflict violence on the man based on his body position, and the position of the man. Idk what his history is, but that might dictate how he comes off here.

So by your logic, everyone who gets in a fight every single day across America should be charged with attempted murder?

Or at least whoever throws the first punch during an argument, drunken confrontation, high school/college party, family gathering, tailgate, etc should get charged with attempted murder?

Dude slapped the guy. He didn't even punch him.

Was he in the wrong, yes. Should he get charged with 2nd degree murder, no. Again, he didn't even punch the guy. No follow-up shots on the ground, No kicks to the head, etc. He lost his cool and literally back-hand slapped the guy for yapping in his ear.
