Again in the case of Olivia Matte, she should be charged with 1st degree murder for a 3rd DWI in less than a year. She premeditated the idea to drive over the limit.
you gave me the impression that she was charged with it...and shooting the shite, layman talk. she's a murderer...but first degree murder the issue isn't whether she had the intent to kill someone...she certainly understood she could kill someone. she didn't say "oh i'm going to kill that motherfricker"

and yes that girl should go to jail for a very long time...she actually killed someone.

Premeditation is only one qualifier for 1st degree murder. There are several depending on the state:

Premeditation
Victim is LEO/First responder
Murder was during the commission of another felony
Multiple victims

That's off the top of my head. Sure there are others.

I know when I choose my home defense weapon, I'm always trying to find just the right balance between pragmatism and fair to an intruder.

fair enough. i'm not judging. I don't agree. and the emotion or thought isn't unreasonable either. I just don't agree and that standard applied across the board is frightening. I don't trust prosecutorial discretion.

You don't have to that is why this is America and you are free to believe whatever you want. I just would rather we not waste exponential amounts of money on a deadbeat that contributes NOTHING to society and will only make the movie "Idiocracy" a documentary and not a futuristic comedy.

When I read her charges I had the same reaction. I thought "Whoa, that is really harsh."
I understand charging her for all kinds of shite, but it's like they can't charge the dead boys for their stupidity, so now it is all on her. Not that I feel sorry for her, but the charges seem, somehow, inherently strange.

well there's 0 percent chance we're going to do that.

i'm speaking realistically not idealistically. the law as it exists now can be changed. i think we're a ways off from sound proof rooms and bullets behind the ear.

I fully understand it will never happen in this case but I just wish it was legal. It could save this country trillions with putting the deadbeats out to pasture.

I think what most of you and those on your side are missing is the ACTUAL DEFINITION of murder.

Killing someone does not always equal murder.

You ever wonder how someone like StongSaftey would respond if this happened to him? If 3 tPOSs broke into his home with brass knuckles and knives and he had a gun. I wonder how this would of turned out.

Weren't they armed themselves? If they weren't planning on hurting anyone, why arm themselves?

100% justified IMO.

There have been numerous recent incidents where the residents were killed, just for the sake of killing them; the old man and his son in Metairie comes to mind.

These young kids nowadays don’t give a frick, they want rep, and they’ll kill innocents who are willing to comply just for points.

I know when they kicked in our door, they didn’t intend to leave a single person alive. Luckily, one friend made it out and I manned up and found out a lot about myself and what I’m capable of. My friend Chad didn’t have that chance though, may he Rest In Peace.
