I haven't lived a thrilling life, I guess. You might call it "ordinary." I have a basic understanding from civics on how bonds work, but I have never been arrested, nor do I know anyone that has called me for bail money.

Here in the Jackson area, there is a lot of talk about low bonds in Hinds County. An auto burglar gets a $10,000 bond in Hinds County, but they get a $1 million bond in Madison County. The wealthy older lady that was murdered a couple weeks back - two of the three suspects were out on ridiculously low bonds.

In reading this story about the suburban DA having enough: LINK, I noticed this comment:

quote:

It doesn't matter high the bond it set. As long as you have personal surety bail agents they will post a bond for a $50 processing fee and a $25 jail tax. They will put the rest on a no interest payment plan. Until the legislature does away with personal surety bail agents and extending credit on bonds. These thugs will continue to get out with no real money.

Is this saying that the thugs/family of the thugs aren't even having to shell out the 10% of bond set - they are paying 75 bucks to get out of jail and signing a promissory note in which they won't pay?

RORs and PSBUs are, in fact, worthless promissory notes.

If they don't pay, then in most states a bounty hunter can legally track them down. I suspect (but am not certain) they can then perform a citizen's arrest to get him back into court.

That 10% thing isn't accurate. No bail bonds is getting people out with just $75. Some do payments, but they are not accepting just what is due to the jail. They have to get at the least what the jail gets and what their insurer gets. In some states, the bond company can't get you put back in jail for not paying. They have to wait for you to skip court. It is a business that the jails and insurance companies make the most money with the least risk.

Interesting. So, take me through the process of being a misunderstood thug. I rob a lady and get a $10,000 bond set on me. What would my momma have to do to get me out of jail?

Thanks, I've had it since I was born. Sometimes I just want to take a gun and pistol whip people for $20, or go rob a convenience store, but I look down, see my white skin and realize that I shouldn't do such things.

It depends on the jurisdiction and bondsman.

Most likely $1,000 or some sum in that neighborhood.

Depends where it is and the charge. If it is in New Orleans and a state charge(like a felony), a bondsman would charge anywhere from 10%-13%, plus the 3% the jail requires for a state charge. Now, they can do a payment plan, but would have to collect upfront the 3% that goes to the jail, plus the percentage that the bondsman has to pay to their insurer. This can be a few % also. The money your insurer gets is there "fee" for insuring the bond and usually money that is yours, but they hold not it in an account. This is where the insurance company will take money from to pay out any bond forfeiture. The 10% thing is just a rule of thumb and not an actually set thing. The problem with payments is if you don't get your money, and they go to court, you will usually have to sue them and their indemnitor.

Must be nice I know that even if you did those things you'd get off easier or receiver a lighter sentence as well.
