If I were on the jury, I'd vote not guilty. Why is an underage girl not considered accessory to the crime?

The statute protects a class of persons. You want the protected class to be an accessory to the crime the law promises to protect them from?

It is a hideously wrong statute, though. Prevents the defendant from presenting a defense and makes jury nullification the only hope.

I'm not saying the statute is flawless, but it's not gonna happen. It would be political suicide.

And, mind you, if you require intent for these crimes, lots of children may put at risk.

I don't think any legislator wants that.

Convictions aren't supposed to be easy, and people who don't intend to sleep with a juvenile shouldn't be convicted for accidentally doing so.

But it'll never change, no doubt.

I worked with a guy that this happened to in Evangeline parish, around 1988. The girl stayed the night, going home about 8 am. Around 9 am, a platoon of LEO's came in and arrested him.

He did about a year. His lawyer told him that suing the bar he met her in would be pointless.

Didn't the same thing happen a few years ago with an lsu recruit and an underage girl in their high school where she sucked him off then told. He got a year or something before he pled to something lesser and then played for the tigers and now the bengals.

Just curious....to what degree did they misrepresent their age?

I mean, they were in a bar and carried fake ID's. Did they lie to him directly?
