My mother-in-law sat on a Tuscaloosa County grand jury under the former DA.

He told the grand jury which cases to find true bills on and which cases to find no true bill on. My jaw hit the floor when she told me that and she said that they did exactly what he said to do. They use the GJ as political cover and the members of the GJ don't know that they don't have to do what he says.

The investigative unit here needs reform. I knew someone who worked it and left - went back to riding in a squad car - because he said that he had been told one too many times to quit pursuing leads that were heading toward places that certain people didn't want them to go. Simple fact is that you need a lawyer with you at all times: when you're filing charges and when you're accused.

Recusal in cases where you have connections to related parties is considered SOP and ethically required. I've been excused from jury duty because I knew, or had family who knew, those involved in the case.

What you're trying to say is akin to saying that the entire US Justice Department is mishandling the Russia investigation because the AG recused himself from it.

Recusing yourself because you are both legally AND ethically required to do so is not denying anyone anything.

If they HADN'T recused themselves the university would in fact BE liable for not providing adequate counselling.

Touche. I meant I didn't have definitive proof of guilt.

I think anyone looking at it objectively can see the difficulty with prosecuting a case like this, especially when the emergency room folks didn't do all they could have done to collect the forensic evidence. That still doesn't excuse the DA and LEOs apparent nonchalant response. This is a bad deal all the way around.

Doubtful. Saban didn't cover up a rape ring conducted by football players. Plus, how can anyone prove that Saban had any knowledge of the rape?

The counselor might get in trouble if they found he/she didn't do enough to help, but job loss is probably the extent of it. I doubt the athletic program has any repercussions.

Well once all the information comes out then we'll know for sure what happened. But I find it hard to believe that UA would cover it up. Why would a school with its massive booster club out its neck on the line for one guy? That would be financial suicide.

If the PD and ER did in fact botch the investigation, they should be fired and face charges.
