Because my ex hired this new lawyer who is connected to the judge, I'm thinking I need to stick with my attorney.

My goal was to have him file for support, get that up and running, and then downshift to cheaper counsel for nuts-and-bolts followup in the years ahead.

I've paid my lawyer an arm and a leg -- the case stretched on for 2 years before it went to trial.
More extended litigation with him is doable but painful.

I need this bitch's support, because unfortunately I'm looking at likely Catholic high school tuition in a few years. Public is out of the question, and the few charters are looking out of reach.

I don't want to because I want to do whatever I can to foster a decent relationship with my daughter. I know she is going to screw up and not comply with a support judgment. You can't really be a part time mom from jail...

I was in a 4 1/2 year fight and cashed in and sold everything. If you are this committed you may as well keep going.

Lack of cooperation? How did you get sole custody? I have battled an ex as well with a very good attorney. One of the best in BR anyway. Just curious.

It really isn't that bad. They tack on a 5% fee to the support obligation.

Damn man I hope your exes new lawyer doesn't screw everything up.

Friend of mine has a similar story when he fought for custody. His ex hired a new lawyer that had ties to the judge, not sure why it was allowed but apparently the judge still ruled on the case. He forced my friend to pay all kinds of money in evaluations for the kids. Ended up coating him a fortune. He won custody and doesn't get any child support. Not sure if he just gave up on collecting it or what. Then his next wife had 2 kids and their father wouldn't pay the court ordered support. They have some real losers out there.

What is the benefit of going through a judge and not CSS?

It should be the same amount based on income right?

Man if I'm in your situation and have the kid, I'm not risking going back to court for money. You have the big prize, don't phuck around and end up worse off.

nope, both parents are liable for child support, not just the man, if she has income it can be garnished,, if she doesn't the meter will start running, with interest and every time she gets a job child support will be paid first, baseline must be established by a court order

The short version is she alienated my child, and refused to allow me to see her. Obviously after 4 1/2 yrs it was much more in depth than that.

I am left trying to fix my little girl's world, and she continues to be uncooperative. You would think after all of this she would get the point, but I guess not.

But CSS will garnish wages

I don't see the point of taking it to court

Actually I believe in la you have to take your order to CSS to have them garnish wages so going to court seems like a waste of time

It really isn't that easy. You have to do a worksheet, they need your income statements, the opposing party's income statement (and I suspect that will need to be subpoenaed), cost of child care, education, etc. This is usually done first, then a court date is set, and a judge makes a ruling.

I was on the receiving end of all of this and got slapped with a huge child support payment. It was a serious PITA. It took quite a lot to get the garnishments to stop, even after I won custody.

went through that, that's truly like trying to get an act of Congress, as to the amount, can't speak for La but in many states it just comes off a table based on the income of the parents, even if one parent isn't working, what they've demonstrated in the past that they can earn can be used, because mine was such a deadbeat I had to hire an "expert" to determine what she should be able to make if she'd get off her lazy arse and work
