Careless operation ticket

So I get pulled over for doing 55/40 on a 4 lane highway...I didn't see that the speed limit dropped because there was a lot of 18 wheeler traffic in the right lane and missed the sign. No big deal I'm thinking, I'll pay the ticket and move on with life...honest mistake on my part. Cop hands me 2 tickets and says 1 is for 55/40 and the other is for careless operation. I ask about the careless operation and he says that anything 15 and over is considered careless operation. Is this legit? The statute doesn't mention certain levels of speed but the way the it's worded, it could possibly be used as a catch all for anything( LINK).
Cop was nice and I was nice too, he looked like he was ashamed to give me the CO ticket though. He was really young and spent a lot of time looking things up..I think someone on the radio was calling the shots for him.

That sounds like a situation where you write one or the other, but not both. Particularly since you were just speeding. Call the DA's office or go by in person if you can.

In AL that sounds like reckless driving. You have to be doing something retarded for me to write you for that because it carries as many points as a DUI.

Section 32-5A-190

Reckless driving.

(a) Any person who drives any vehicle carelessly and heedlessly in willful or wanton disregard for the rights or safety of persons or property, or without due caution and circumspection and at a speed or in a manner so as to endanger or be likely to endanger any person or property, shall be guilty of reckless driving.

Well I can appreciate the fact that you're accepting responsibity for speeding. Fight the CO ticket on the court date maybe?

He has officer discretion. If he felt like you were being careless then he can write you for that also. IMO I wouldn't write you for that. Were you weaving in and out of lanes?

Sounds like double dipping to me. bullshite ticket and the careless op should be dropped. I'd contact the DA's office and ask about it

I had only had my license for two weeks when a Mississippi state trooper stopped me. He gave me a ticket for doing 75 in a 65 and a Reckless Driving ticket. When I asked him why he gave me the Reckless Driving ticket, he said he thought it would have a big influence on how my parents punished me for getting it.

He was right. It pissed them off & I got grounded except for driving to school & work for two months.

His mobile home was egged two weeks later.

Careless Driving in Ms usually consists of two offenses, such as speeding and improper lane usage. Reckless Driving consists of putting lives and/or property in danger.

A trooper was running a Roscoe P. Coaltrain type speed trap back when I was in college. He ticketed me for going 55 in a "45" (not a sign in sight and that stretch had always been 55). I'd moved the week before and told him to change the address on the ticket or at least note it to make sure I got the mailer. He didn't do it. Ended up having to overnight a certified check to cover it.

Anyway, he happened to be assigned to the student section during football games that year....seven home games of insults, cat calls, and payback. He'd get so pissed he'd just about cry. I got my $150 back in entertainment.
