Car Repair When other Driver at Fault and has Insurance

Daughter was rear ended. Other driver has State Farm for insurance. I have their policy number. Do I contact State Farm to initiate the repair process? FWIW, I have Geico and other driver was ticketed for careless operation.

Assuming the other party reports it timely, SF will contact you to schedule an appraisal and request statement of your daughter. If you are not contacted within a few days and have their agent's name contact them to confirm it was reported.

They owe you a similar rental while your car is under repair. If not driveable they should initiate rental immediately. They will not pay for collision or comprehensive on the rental but if you have such coverage on your car it will transfer as a temporary replacement vehicle so don't pay the daily insurance rate to the rental company if you already have the coverage.

The citation against the other driver is not the determining factor for liability , but sounds like he was at fault.

Report it to both. If you're in Florida, the other driver has to have $10k in property damage coverage. If SF fricks around about the repairs, you can go through Geico if she has collision but that may involve paying a deductible until Geico recovers it back from SF in subrogation. It sort of depends on the adjuster whether Geico will waive the deductible upfront since the other driver is clearly at fault.

We are in Louisiana. I was hoping not to involve Geico. Daughter is a minor and I do not want them even thinking about raising her insurance.

GEICO will only raise your rates if its a chargeable accident.

No real reason to report it at this time other than records only since you are awaiting contact by State Farm. You would incur a deductible if you pursue a claim under your policy.

I had someone back into me in a parking lot (Rouses).

Their agent called me, and I called my agent. I have Geico as well. They both called me and had me give a statement. Neither of us were ticketed, and it was found to be 50% responsibility. I didn't care about that as much as Geico raising my rate, which they said they weren't going to do. So, if they didn't in that instance, I would imagine they won't in your daughter's case. But, I'm pretty sure you should call Geico and report that it happened.

No, contact your insurance and file a claim, your adjuster will contact the other party.

They will waive your deductible once they find the other driver is at fault.

You just better hope the other party assumes responsibility. All they have to do is tell their insurance they were not at fault, then it starts a whole long bullshite investigation.

You'll end up paying your deductible and using your insurance fix it, then twiddle your thumbs for months hoping they'll go after the other insurance and reimburse you.

Yeah it sucks.

Try posting your questions on the OT and hope no one asks for pics of your female family members then go with what makes you feel good.

La. R.S. 22:1296(A):

"A. Every approved insurance company, reciprocal or exchange, writing automobile liability, physical damage, or collision insurance, shall extend to temporary substitute motor vehicles as defined in the applicable insurance policy and rental motor vehicles any and all such insurance coverage in effect in the original policy or policies. Where an insured has coverage on a single or multiple vehicles, at least one of which has comprehensive and collision or liability insurance coverage, those coverages shall apply to the temporary substitute motor vehicle, as defined in the applicable insurance policy, or rental motor vehicle. Such insurance shall be primary. However, if other automobile insurance coverage or financial responsibility protection is purchased by the insured for the temporary substitute or rental motor vehicle, that coverage shall become primary. The coverage purchased by the insured shall not be considered a collateral source."

You can still buy the coverage (and, if you do, that coverage will be primary to yours).

Only get your insurance involved if SF drags their feet and is taking too long.

Also, get a copy of the police report as well as pictures of the damage to your vehicle to send to the SF adjuster. That should help to expedite the process.

Was/is your daughter hurt? If not, that's great. If so, then I would make sure not to settle any type of bodily injury claim until you are sure your daughter is ok and fished treating. If your daughter wasn't at fault you don't want to be stuck paying medical bills for injuries caused by someone else.

I recently dealt with a total loss vehicle after being hit from behind so this is my recommendation. (I'm with USAA)

Like others have said but I'll reiterate. The sooner you call your adjuster the better, it's not like this is a big secret where you should only contact State Farm. Include things like police report, pictures of the car damages, insurance information of the driver at fault. The more information the better.

I don't know how it is with Geico but I had the option to select the collision center for the estimate.

It is the adjusters job to handle all of the background work for you as they will contact the other insurance company as well as yourself for a statement.

Stay in contact with your insurance, ask them for things they may need to help expedite the process. You wouldn't believe how long these things can drag out if you just sit around.

In my case it was relatively cut and dry that he was the driver at fault through 1) police report 2) photos 3) statement and I'm assuming it will be the same with your daughter.
