Did you blow? How are you gonna beat the rap if they gave you a breath test?

They didn’t ask for a breathalyzer, they wanted a blood test.

Fair enough. Any prescription medications or street drugs?

I know a guy in Austin, he’s a good friend and a great lawyer. Not sure if he’d handle a case down there.

I asked for counsel before agreeing to a blood test, counsel never came. Why would I give the police evidence of things I may have done weeks ago to support their case of driving while intoxicated?

Do I have to reiterate I wasn’t drunk? Do you think if they thought I was drunk they would have wanted a breathalyzer? Because they didn’t.

That makes no fricking sense. They charged you with DUI without offering the breath test? I find that really really really hard to believe. Hell, I'm not sure if there's a traffic cop left in the civilized world that doesn't carry the portable breathalyzers.

I take anti anxiety medicines stemming from when I get shot 4 times and saw my friend killed (y’all remember that)? But I hadn’t taken any that morning. Which is why I didn’t submit to a blood test, because if I had the previous days doses would have come up and been used as evidence as intoxication.

So basically, they failed you on the roadside test, took you in on dui, demanded blood, and you refused.

Did they offer the breathalyzer?

You should be able to beat this easily if not.
