Black or African American?

I'm writing a legal brief in which I need to refer to several parties by their race. In it, I have listed white and black, but the partner reviewing the document asked that all references to "black" be changed to "African American." I responded to her that there was nothing in the record indicating that the parties were from Africa. She wasn't happy.

So which is it? Black or African American? FWIW she didn't ask me to hyphenate any of the white references.

Is the legal term for their race African America? I really don't know. I see it all the time on legal docs.

According to my black buddies: "Unless you're from Africa you shouldn't refer to yourself as "African American"".

This is really my question. Not trying to be racist, but I don't think African American is the correct term.

African-American is a misnomer since it's meant to denote someone of the sub-Saharan negroid race, but since Africa is a continent that contains peoples of all 3 major races, it is factually inaccurate.

I think that she is correct to use the term African American; however, it is interesting that she didn't recommend using the term Caucasian.
