They are cheap as frick and shady. I know how you feel and all these arse hats telling you to chill are dead wrong because they don't know what you are going through.

If any other poster were in your shoes they would be livid. I hate to say it but your best option is to go through your auto carrier and subrogate because USAgencies will deny, deny, deny. Point blank, they are shady and a poor excuse of a company.

Hitting a parked car is a personal property damage claim. There shouldn't be a deductable.

You file a collision or comp claim through your carrier, you are subject to the deductible. Only time I've seen it waived is when two cars in an accident are insure by the same company; like when someone's wife backs into the husbands car in the driveway.

Not the case when my wife hits parked cars.


Eta: she leaves notes on the car that she hit and they call us we try to settle outside of the insurance company sometimes that doesn't work so they File a claim with the insurance company as a property damage claim insurance company pays it, no deductible.

This is why you purchase insurance from a reputable company, and let them handle the repairs, then subrogate. They even will collect your deductible.

If you want to fight the other side, you really have no leverage until you sue them.

Exactly, so why should I have to drive anything other than what I currently drive? Size or convince wise. While my vehicle is being repaired by the at fault company.

Also, I have state farm. I have been in a couple of accidents before, and never had an issue going through the at fault company getting things repaired or having rentals put in place.

Yeah well, I never knew that. They didn't believe the insurer, they went by the generic police report.

the Farm is a great Company. USAgencies is not. Turn everything over to the Farm under your collision coverage and let them get you a rental vehicle. Then let them subro against the tortfeasor and get your deductible back.

Bottom line: you had the bad luck to be hit by someone with crap insurance, but that is better than no insurance. If you want to go to court and tell the judge about how humiliated you were to drive a Yugo for a week instead of your tricked out Daiwoo, he may award you something extra, especially if you bring in some Twitter or Facebook posts making fun of you for the hoopty. Otherwise, live with it.

CW, you seem to be spot on with your insurance knowledge. Can you help me out with question?

Friend involved in MVA with US Agencies. Their driver clearly at fault, rear ending witnessed by police who issued their driver citations, etc.

Friend's vehicle totaled and towed to wrecker yard 12/19. US Agencies calls and says they can't get in touch with their driver, and won't do anything to settle PD until then, or they get police report. Police report still not ready.

US Agencies calls and says they will not pay storage charges past 1/3/14. Says it is his responsibility to move it. He doesn't know where to move it. Called storage yard who says they need order from insurance company to pick up. USA says they will deduct storage fees from PD settlement. Says as long as they send letter telling him they will not pay, they don't have to.

I say that they haven't even accepted liability, and have surely not made him any offer on PD settlement. They haven't sent anyone even out to assess damages. They are responsible for all storage, up until they make offer to settle.

Assuming USA is at fault, do you agree? What should friend do in response to this threat to reduce PD payout by storage fees?

Anyone welcome to chime in.

Does he have collision insurance? If so, bring his carrier into play.

If not, go buy a new vehicle and be prepared to sue US Agencies over the PD.

If they want to play a game with you then you play right back with them.

As for a rental, they are supposed to pay for a rental of the same approximate size of the vehicle you have now.

Also, be careful not to get replacement parts that are from a vehicle that was in a wreck before. I know for a fact that State Farm will not give you new parts to fix it. They want to use parts from a vehicle that was involved in a wreck. So if you need a rear bumper they will find the same vehicle type that was involved in a front collision and give you its rear bumper.
