Guys again, in no way shape or form was I parked illegally. I even went to the police department and met with an officer myself to discuss this. The only reason I brought it up was to show you guys the type of squirrel I am dealing with.

Yeah always get the report with a statement of facts. You don't have to file a claim just because it's reported.

You still stand a decent chance against this guy in any legal proceeding assuming you can provide at least one witness and some record of your communication with him.

Yes, you can. In many places cops won't even respond to write one unless someone is injured. They often won't write them for private parking lots, etc.

Not having the report may not help, but it does not preclude you from making a claim.

Option A: If you want your car fixed soon, make a claim on your own collision coverage and get things going. Your insurer will likely turn to the other guy's insurer for reimbursement.

I've had this scenario twice (once with police report, once not because Dallas), and my State Farm insurer handled it all with a smile. They even got me back my $500 deductible after they collected from the at-fault driver's insurer. If you have a shitty 1-800 insurance company, your mileage may vary. They also assured me it would not affect my rates since we were not at fault. So why not let them handle it and get the car fixed immediately?

Option B: You try to deal directly with the other driver's liability insurer (if the a-hole really even has coverage).

This can take weeks or even longer as they have an adjuster look at the damage, you play telephone tag, and they try to quibble with you on who was at fault, the amount of repair, etc. Meanwhile, your car is wrecked, and they wear you down to accept less.

Option C: The guy has no insurance and you try to collect directly from him. Likely a waste of time. Go back to Option A and let your insurer decided if it is worth their time to sue the guy for reimbursement of what they paid you.

If you have his insurance information and everything else, just contact your insurance provider and start a claim with his insurance provider. It's all you have to do especially if you have witnesses.

Open a claim with both your insurance company and his insurance company. If he fights his own insurance, let your company go to bat for you. If it is getting stalled, lawyer up and go after him and HIS insurance company.

You have 5 witnesses, this shouldn't be very difficult, especially since he gave you all his information (basically admittance of wrong-doing)
