A nobody poster asking a legal question

I'll keep it short and answer any questions needed to get an answer.

Charged with DUI (.08 TN). Convicted of DUI. Now have suspicion that the blood test did not reveal a .08 but a lower, legal bac. How, if possible, would one be able to look at test results after the fact. Who to ask, I guess.

ETA: No attorney present at court. fricked up and deserved more than the penalty given if guilty Imo.

i'm not a Tenn lawyer, but did you get discovery/disclosure of the results? do you think they were falsified, if so?

in LA there are ways to attempt post-conviction relief, but i don't know if Tenn has the same process

Yeah. I'm wondering if a citizen could request to see his without having to hire an attorney.

I'm not an attorney, but I do know that being above the legal limit is only part of the equation for a conviction, i.e. whatever the BAC was, combined with other contributing factors can convict. Might be too late, but it never hurts to ask. Good luck.

What you would be asking for in Louisiana is "post-conviction" relief, or possibly an appeal, if you are still within the time delays.

For something this serious, you might want to call a professional attorney in your jurisdiction. You might change the battery of your car if you're comfortable with tools. You might call a professional to fix the breathing machine that keeps your child alive.

Know what I mean?

If you got convicted then they look at the test results, no? I got a DUI but blew zero and they dropped everything as soon as I walked up to the podium.

I asked at first court date to see the results and was told that the State Trooper didn't have them. I was given a continuance. Next court date I was told by the DA that it was. 08. I took my punishment and learned how to call a cab. I have now learned that this trooper was caught lying about these results in a DUI case. I slept off 10-12 beers for 3 hours and fell asleep at the wheel. Didn't ever think I was going go to get a DUI. I thought I'd be fine

Drivers often blow lower than the legal limit and are still convicted of driving under the influence.

Was also given a test on interstate and had no issue at all with any of it.

Worth a few bucks to find out and maybe get it reversed. I'd hire a lawyer, after a thorough vetting, to look into it. Odds are the financial damage has been done, and as the lawyers say, that bell can't be unrung, but you might be able to get it off your record.

Right. In his case it was stated by the trooper that I blew 08. However I was never able to see results on paper from hospital. Also it seemed like the trooper was kissing my arse at court. The second court date.
