Unfortunately I agree with this assessment. That being said, I doubt this kid would ever see a day outside of a mental institution, and I don't think they should.

That isn't enough to be fit to go to trial. Do you think a 5th grader, and one as mentally unstable as this, understands what a verdict is? What a jury is responsible for, how a judge is supposed to act during a trial? How would a lawyer begin to explain different situations and tactics to an 11 year old?
Don't misconstrue my opinion that this kid should be allowed to be integrated back into society. There are obviously massive issues there.

Maybe? I honestly don't know. If you're talking about a true Bundy style sociopath, at that age are they capable of processing what they did is one of the most horrible things on the planet? I doubt it, they just know it's "wrong".

this is a horrible act. Hurting a child, even if by another child, is a situation where rehabilitation is likely not an option.
when someone is a danger to those that can least defend themselves, that person cannot be trusted within the constraints of society, regardless of age or mental capacity.
