I'll try to keep everyone updated on the hearing today for anyone who can't keep up with the live feed @ LINK

It looks as if everyone has arrived and waiting for hearing to begin.

Note: Last hearing, Jeffrey Kessler was the only NFLPA attorny present. Now, the whole team is there.

quote:

@rjonesTP: Peter Ginsberg and Duke Williams here for Vilma.

quote:

@rjonesTP: Berrigan is here. Parties are introducing themselves

ETA: Judge Ginsberg did not give a ruling today but clearly stated she wants to rule in favor of Vilma. She's giving both sides a chance to settle or the arbitrator to turn it over at the AUG. 30 hearing (Burbanks hearing). By her doing this, she is actually trying to help Vilma. If they were to settle or it get turned over she won't have to rule in favor of Vilma and then have NFL take it to the 5th Circuit to appeal her desicion. Kessler (NFLPA attorny) made some strong arguments and points today and was not backing down. He was very impressive as the judge said so herself. We shall wait and see what Aug. 30th brings us!

@rjonesTP: She's starting with questioning Ginsberg

quote:

@SportsLawGuy: Judge starts things off- I'm not going to restrict what anyone says about anything. Starts by asking about cartoffs.

quote:

Judge Ginger Berrigan has questions for attorneys. First Q for Vilma team regards meaning of cart-offs. Said term sounds like a bounty

quote:

Judge- seems to me that cartoffs, as defined by Vilma and Vitt, ARE bounties. Suggests that Vilma admitted bounty.

@SportsLawGuy: Ginsberg answering that cartoffs were plan of Gregg Williams. Vilma was making good clean play. Goal of cartoff to "knock wind out of plyr"

quote:

Vilma lawyer Peter Ginsberg said cart-off was team-generated, Gregg Williams-generated lingo

quote:

@rjonesTP: Berrigan shoots Ginsberg a tough one to begin. Asks about cart-offs and how they take players out of game for paid reward:

quote:

Berrigan: "It seems to me that in effect is a bounty. I know Vitt/Vilma made a point to say it was legal, but..."

quote:

Ginsberg coming back to argument that Vilma was punished for putting money on head of specific players and there's no evidence of that.

quote:

Berrigan: "...I'm not sure there's a lot of difference."

quote:

Berrigan: "Mr. Ginsberg, I'd like to e candid with you, I'd like to rule in Mr. Vilma's favor."

Judge- "I would like to rule in Vilma's favor. I do think you exhausted your remedies."

quote:

Berrigan: I do think you exhausted remedies before Mr. Goodell. You were thwarted at every turn by Goodell. Penalties were too harsh

However, said doesn't know if she can do anything prior to a hearing on 30th

quote:

Berrigan: However, I don't think you've exhausted remedies under Burbanks, so I'm not sure I can do anything. Please explain.

Judge thinks process was unfair, punishment excessive, and that RG did not have power to discipline in these cases.

But, judge thinks that players still have to exhaust appeal pending of Prof Burbank's arbitration decision.

quote:

Judge- if I can find a way to legally do it, I will rule in Vilma's favor.

Sounds like she won't rule in Vilma's favor, but she wants to.

Great updates. Does anyone think this will affect Payton as well? I understand this is strictly for Vilma, but if Goddell is made a fool of, is it possible Payton's suspension is shortened?

Not from a legal standpoint. IMO

Perhaps it allows RG to reduce SP's suspension but only if he chooses which I doubt

After hearing what this judge is saying, the NFL might want to restart that settlement talk again. Maybe 3 games for Vilma and Payton and see if Vilma bites.

Judge now discussing defamation suit. She is troubled by preemption argument. Ie, that defamation suit is preempted by CBA.

I'm reserving judgment. Definitely some good sound bites from the judge, but also some big looming questions. Judges do this sometimes...particularly as she knows the world is watching...it looks like she's setting up for "I really want to help you but my hands are tied."
