We won't see a coaches' union ever because of the way labor law is written.

he would probably just cost us that IR tag that we can use on a player to come back.... you know we're going to end up needing that for one of our running backs..

No he would be on the PUP since he hasn't been able to practice. To be on that list you have to be on the 53 come week one.

Hmmm. This conflict of interest issue is new, as far as I know, and may be the first bad sign for the players.

She's made it clear she doesn't like what Goodell did, loudly. The irreparable harm element was always the best hope for the players to get the TRO issued so they could play, a la Starcaps.

But if she is indicating that the attorneys aren't legitimately participating in settlement talks because of prior conflicts, the players may lose her sympathy.

I honestly don't know what to make of this but it's the first bad sign that the judge may not be willing to go to the mats and risk appeal for the players.

Why does this:

Make you think this:

the players may lose her sympathy.

I would think its the other way around. The lawyers/NFL are basically dicking around and not sticking to an appropriate schedule. Shes seemed pissed off already at the way they are handling things, i can only see that as a positive for the players.

The tweet says she issued a show cause to the NFLPA attorneys why THEY should not be removed for conflict of interest, indicating they are the ones not fully participating in settlement talks, not the league attorneys, and points to Kessler specifically.

The show cause is against the players representation and specifically quotes Berrigan as saying they aren't representing their clients best interests in settling bc of prior bad relations with the league.

This is a very bad sign for the players.

No idea where this came from or why she suddenly feels this way...

Unless this is all part of her trying to find a way to justify the TRO. Players need more time to to ensure effective assistance of counsel...

But damn this would be a wild way to go about it...

Maybe it's a CYA thing to show she's not biased towards the players. It should be easy enough for the Union to point out why talks are pointless with the way the league has behaved.

Or it could be a judge pissed that the union is relying on her to bail them out rather than trying to fix the problem themselves.

Yeah saw the Ed Werder tweet and was coming to post.

But I'm not sure where you're getting this is bad for the players. They are trying to decid on whether to get an injunction to ALLOW the players to play

ETA: am I reading too much into that tweet or does it sound like he might have revealed the way she is leaning?

Shits gettin real. Should have some resolution soon. At least as much resolution as we're going to see in a while. I have a feeling we'll see the player suspensions lifted...for now.

It really is coming out of her sympathy for the players individually. Right now the NFLPA attorney is representing the NFLPA, Fujita, Smith and Hargrove. The Judge is now questioning whether the NFLPA attorney can also represent the best interest of the players, especially in settlement talks, due to the bad blood between the attorneys for the NFL and NFLPA from past disputes.

I think she is still with the players but just tired of the grandstanding between the NFL and NFLPA while the interests of the specific players in this case are potentially overlooked.

Good points. I think that would be better for the players then if I'm understanding correctly. If she rules in favor of the players, and holds this thing up in court, they will likely play out the year and probably retire into the sunset.
