Because he never intended on just cuffing the rapist and and taking him. He was going to hand out his own justice from the moment he walked into that place. The police (and everyone else) knew it and weren't about to get involved in it. You have to suspend some disbelief in that show considering it is about an ex-con you takes on the identity of a dead sheriff.
