Been knowing him for about 13 years and never known him to wear a gi or train with BJJ players at all

Well then there is no way he will be fighting in the UFC! Seriously though I didn't, I saw his last fight was in the UFC and figured he has been injured since most guys go onto fight other places after the UFC. I was ringside when he beat the shite out of Cale Yarbough though!

He had a brain tumor scare that sidelines him and during his time off had his first child. A second child has since come, he is 36 and has literally one of the most successful gyms in the country

There are quite a few in Louisiana now it isn't such an anomaly anymore

Is it true that in BJJ you don't have to "earn" belts by doing tests or anything. You can just have someone who is a black belt say you are a certain belt and then suddenly you are? I was watching a Chris Weidman interview and he was asked what belt he was and he said,"Well my trainer just told me I was a blue so I guess blue?" Then they asked some other dude he was with the same question and he had pretty much the same answer.

You are supposed to be promoted after showing an ability to comprehend and execute certain technique. You can be promoted through literal tests or through performance in competition.

Shoulderchoke said it nicely, but I'd like to expound if I could.
Ever BJJ belt is earned, there is no doubt. But often times it isn't through a formal belt "testing" procedure. Everyone's journey is different, and it is hard to know exactly where that person began their journey. And for that reason, it is hard to criticize or judge anyone's belt level unless you are intricately involved in them achieving it.
You can prove your proficiency through competition, in class application, and a number of other similar ways.
I know Tim has evaluation days I think monthly, and promotion days once or twice a year. He will evaluate your level on eval days by asking you to perform certain movements and concepts while he watches, or rolls live with you. He is also evaluating in class and at tournaments all year long
Then at the promotion day, he will dole out what symbol of advancemt and improvement he sees fit.
Other instructors will just pop in class one day and hold an impromptu ceremony that day because he felt you have finally earned it.
A freak athlete who is a voracious competitor and holds a purple belt might absolutely smash in competition a black belt who put in a lot more time, and learning about techniques, and just is not as physically and mentally gifted as the purple.
That doesn't necessarily take away from the black belts credibility. No one would ever argue that nick Saban was a better DB than dee milliner, but Saban is certainly a black belt in the defensive backfield. Dee milliner is the player he is today because he had the instruction of such a knowledgable and well versed instructor

Derek is a brown belt under Tim with over 10 years experience. To put him in the same category as Ricky in BJJ, serious or not, seems insulting. I've seen Ricky train occasionally in the gi within the past couple years, but nothing serious.
Marco Macera, Mathias Meister, "Doc" Eddie Lirette, and Caroline Vanek are also black belts. Caroline was recently promoted, first female black belt in Louisiana that I'm aware.
